Oversea Hosting/Copyright Materials?


I live in the United States.

Firstly, I'm thinking of a setting up a website that "may" have copyrighted materials from Japan, China, UK, South Korea, and materials from here. Now I'm left with a question, should I register for an overseas domain (if you have a link to a good oversea domain registrar, please provide one)? Or should I just register for a domain here in the United States?

Secondly, what are the problems that usually arises with registering domains oversea?

Thirdly, now say I start up my website and I do host copyrighted materials from China, Korea, UK, Japan, and from here. Would I be able to avoid copyright laws, or essentially, will I get into trouble here in the United States and with other international laws if my domain and web host is located overseas?

This might be a bit too much, but its just some of the hurdles I want to avoid when I actually do start up my website. Thanks.

The above is all about shared webhosting, but what if it picks up and I have to go to dedicated servers? Does the laws that apply for shared webhosting the same for dedicated servers?

Any other information you can give me regarding "Copyright Issues", which is what my main concern here is, would help very very much.

Well, your biggest problem isn't your domain. It's your web host!

If your web host catches wind that you are using copyrighted material or have copyrighted material on your site chances are your account is going to get suspended. I don't think it matters what type of domain you register, yes a registrar not located in the U.S. will make it more difficult for U.S. authorities to repremand you but if you use an ICANN registrar you will run into a problem if legal matters arise.

I think if you don't have a popular site you may be ok, but if you get a popular site your host will get DMCA's up that yazoo and eventually deny you service.

Yea your domain will not be your biggest concern, hosting is going to be a little more difficult. You will need to pick some specific web hosts since you may or may not be getting DMCA notices...especially if this web site is large.

The rules should apply the same for shared and dedicated hosting, but if you do shared hosting, you may be watched a bit more closely. I'd start with shared I guess to save some money and see how things go from there. Try to get a host in NL or Ukraine maybe. There are several hosts over there in Europe that are lenient on DMCA complaints, like Leaseweb.com. Check them out for their shared hosting offers.

I would register a domain in the U.S. and just use an overseas web hosting company.

I think most of hosting providers do not allow copyrighted materials unless you use your own server

Your best bet is Netherlands or Sweden they have the most relaxed hosting laws of all

A Pretty bad idea if he is in the USA.

Use a country Toplevel Domain of an Offshore country (and please, not .de) - .co .ru .kz or so, they usualy dont care what you host and dont even speak english.

Get an offshore webhost - prefferably not NL/DE or EU at all - Asia falls out to as you say, so there is practically only Africa and South/Middle America left, maybe Panama?

That is it pretty much - you can do the same with a .com Domain,like from internet.bs - Domains are very hard to seize (as we can see on TBP and various warez sites under .com and .org Domain names)

Realistically, the problem isn't where you're hosting the data, or where you register the domain. The problem is where you live. You're the one they'll go after.

To that end, either move to another country, or kill this copyright violating idea before you even start it.
