My nightmare with allreseller

in my search of new server i found allreseller, seems to be nice webhosting company, i got about 5/6 months with them and its a NIGHTMARE.. too many downservers (many times ALL my sites went down about 14 hours, mysql stop working by many hours too.. php seems death even to the next day.. change dns servers WITHOUT notice.. in my reseller hosting with them all mi sites and clients are mad at me because an non professionally company like allreseller is...

i got all these tickets...
RGF-143271
DQF-340062
EPS-131220
VCI-724377
CJF-393244
HOJ-344061
IYX-822445
KPV-636978
XBU-578926
OQJ-478976

sometimes they say "the hard drive trouble" we will replace but after theirs fixings.. more troubles shows up... the "promess" "this is it.. no more downservers" but still happenning and hapenning.. i am tired of this situation they should refund for the remaining service period as they say in theirs SLA (Service level agreement),

Quote:
Money Back Guarantee
If for any reason you are unhappy with our service, and wish to leave during the first 30-days, allReseller will refund your purchase price less applicable fees in full. If after the first 30-days of service you become unsatisfied with your hosting service allReseller may pro-rate your refund for the remaining service period at the discretion of allReseller's staff. For billing discrepancies / disputes please contact us for quicker response before contacting your card issuing bank. Domains, dedicated servers, and VPS servers are not eledgible for refunds. If you cancel/request refund an account that included a free domain this voids the money back guarantee and your domain can be transfered/pushed into an enom account for $12. If this domain isn't claimed within 30 days of the cancellation it will be either suspended/parked on allReseller until the fee is paid, or the domain expires (whichever comes first).

i request a refund but the answer to i got was..

I am really sorry to hear that. If the downtime was caused by a hard failure then it is not their fault, it just happens. Problem is how did they managed to solve the problem. Hopefully next hosting company will suite your needs, good luck in searching

Clearly in their TOS it does state:-

Quote:
We will not refund past the 30 day period however, you can cancel at any time
So in reality this means "you are" entitled to a 30-days money back guarantee

They cannot say they do not give refunds as their Legal Agreement says otherwise, if you were to break the terms of your account then yes you would forfeit the refund though it does seem like this webhost might be run by a couple of kiddies by the sounds of things.

Just because they say they won't do something after 30 days doesn't mean they have any obligation to do it before 30 days either.

If I tell you I won't paint my car red next month doesn't mean that I have to paint it red this month either.

Yes, that might be the case Mike but if they "CLAIM" it in their TERMS they are legally required to do so as long as the client has not committed acts that may violate the terms.

You are lucky and can ask for chargeback. 2CO is in your team.
