    if web hosting account expires, is there something we can do to get the files back?

    if an account we have with a hosting company runs out, are we allow to claim the backups or anything???

    i'm unsure on all the laws/rights we have with this anyone have any idea?

    Depends on the hosts policies for backups, they may delete them when you close the account.

    It doesn't really say anything about getting backups while you're a customer either. Hosts typically don't guarantee the availability of data or backups.

    Generally, I would not rely on the host giving you a backup of your data after your account gets suspended for non payment. the most likely scenario then is that you'll be asked to pay up, your account will be unsuspended, and you'll get the access to your data as you wanted.

    If you cancel the account properly, you might stand a chance that the host will be willing to oblige to your request. I suppose that the backups will be gone within a few weeks though, in one of the better case scenarios. The host is still under no obligation to provide backups, unless explicitly stated in the TOS (I've never seen a host do that).

    There are 2 lines here, Suspended account or Terminated account. Usually a host that Suspends and account or automatically suspends an account due to non-payment, Will keep the account alive but in a suspended mode and all files kept on server until a payment is made.

    If not payment is made on the clients behalf on a certain amount of days (30) usually, Then the account turns into Terminated mode where the files are automatically deleted from the server.

    I am not fully sure if hosts that do backups keep old backups of accounts that are not hosted on their servers anymore, But if this is the issue, Then contacting the webhost in relation would be the best option. Usually if you have contact with the webhost then the chances of a Last Updated Backup might be promising, Though if you delay for months and months and then demand a backup you may be out of luck.

    If the Backups are done Off-site, Then they may be able to provide you a backup of the last updated files to yourr account.

    If your hosting company does not forbid to create back-ups on your own, you can move the data yourself. Also, that is normal for hosting companies to allow you to move the content of the account when the period is expired. If they close access for you, you will need to address this question directly to them, if you still have access - I believe you can move the content since it belongs to you anyway.

    If you call the webhost in question and if the account is suspended, Then they may be able to un-suspend the account for you to retrieve your content to create your backup of the files. From this point your account may become redundant or terminated.

    Well I someone said above, it depends of the provider's policy, but the general answer would be "No". It does not make sense anyone to allows you to get back-ups when you subscription period expired. The best answer of the question "Why" is the same as the question "Does your wireless phone service provider allow you to make a call once your subscription expired and after the account is suspended".

    I agree with HostColor.
    Why don't you simply renew your account with them and continue hosting the site? (assuming that they still have your files and you don't have a copy)

    It is very possible that the host still has a backup of your site right after you terminate your account, they are not under any obligation to give it to you though. I'd contact Host Nine directly to see if they can help you out

    Simple answer is no. Once your pre-paid time expires, your service provider has no obligation to provide any further service until it's renewed.

    Well if your account is suspended due to non-payment, the hosting provider will not provide you with any of your files. What I suggest you to do is to clear your invoices and have them activate your account so that you can retrieve your files and databases. This should be the way to go.

    is there not something to do with the dataprotection act i can push them agaisnt to get a backup?

    Not really, they can just claim to of deleted everything.

    If you chose to not take your own backups, and chose to not continue hosting with them (or chose to violate the terms, getting kicked off), then you're out of luck.

    Martyn, have you tried to contact the hosting? What did they tell you? They should have informed you about possible alternatives: whether the content of the account was removed at all or if you still can get it (for free or by paying the fee).
