Sell illegal templates in CD and hostgator will host it legally.


Last week my brother puchased a CD which promised contains thousands of unique templates through http://nicetemplate.com
He sell it locally for Indonesia market and leave no contact info.

He showed me and I'm surprised that what did guy did is copied from all sources included templatesmonster.com majority which is available alot of through the net (example: http://www.google.co.id/search?q=dow...uri&hl=id&sa=2 ), burn it into CD and sell it illegaly.

I reported the site to hostgator.com and got the followin reply:

I'm not trying to bash HG, but I need your opinion: is the HG respond is already correct?

So learn from the same thing, if I set a website sell cracked properties and only delivery the product through CD or email (not downloadble one) I can host it with HG as long as no offensive files in their server? Or in this case HG just ignore it because could not understand Indonesia languange?

Without Hostgator actually having one of the CDs in question it's word vs word. In shorter terms, unless you could show them, specifically, that a law was being broken (instead of just saying so) then perhaps they would take action.

Yes, I know, but for me is not a big deal if HG will not shutdown the web site because even if I send one to US (which will cost alot of money) HG still can thinks that CD is made by me.

The worst thing for me is my brother spent around $8 and got cracked templates which is easily download from the net. Not big deal.

I'm just curious with their policies.

HG won't do much because what he's advertising on his site http://nicetemplate.com are just Quality Templates Pack with Full Resell Rights.

You can buy them for $25 and then sell then on to as many millions of people as you like. There's a ton of companies like the one below.

If he's selling templatemonsters offsite...i.e in the market place, then there's not a thing HG can do or would do, that would be a matter for template monster anti piracy department...and as you see by googleing, it seems they don't care much either, most likely because it's way too widespread now.

As mentioned above HostGator isn't responsible for this as they aren't hosting the illegal content (i.e. templates). If that was the case then this would be a totally different ball game where HostGator would either disable the fraudulent url or shut down the site based on their abuse policies.

If you want to take this up legally which in my opinion isn't worth it, you would have to file a legal complaint with the court which involves a lawyer and a lot of money, again which isn't worth it for $25 if you know what I mean.
