    CPanelthemes introduces XController

    CPanelthemes introduces the new CPanel skin "XController" (inspired by MacOS X and Aqua) which will be released on November 4th, 2002. XController is priced at 70 US$. Until day of release, you can buy at a 30% reduced price (49 US$).

    Do you mean the Aqua design? All icons are original artwork for this skin.

    I have seen many applications that imitate Apple's or XP's design -- these applications run on completely different platforms. No problem.

    I have seen many Websites that imitate the same. No problem.

    This is not a GUI or an OS (would be competitive).

    Where is the problem?

    Apple does not hesitate to send cease and desist letters regarding Aqua (especially when you intend to make money off their trademark). Capitalizing on copyrighted work is a) unoriginal b) pathetic

    Nice discussion. I know it is more than pathetic when you copy a work and offer a clone. But how can a control panel skin compete with any of Apple's products? Is this a copy targeted to the same customers and for the same or similar purpose as any of Apple's products?

    It is something different if for example you create an Alab**nza-like skin for CPanel servers -- you might steal them some customers since customers might think that the clone offers the same functionality. But where is here the point.

    Shall we list the thousands of Aqua-like and XP-like websites?

    Lets avoid a long discussion. Time will show.

    The problem comes down to the fact that you are trying to make money off their work. Perform a search for Apple + Cease and Desist on Google to find out more...

    well regadless ...

    the skin is the best i have seen. PERIOD & i think your products are phenominal. i like the fact that it integrates with your other fantastico product. i will definately be making the switch so look for my order soon.

    keep up the good work and the clean interface development. you put all these other skins to shame !!

    It doesn't matter if your skin competes with Apple directly or indirectly, you are using copyrighted work. The Aqua user interface is trademarked by Apple and they have a long history of going after people who use it for commercial gains.

    Alabanza vs. CPanel? How's that relate to using Aqua and copyrighted work? It doesn't! Next?

    Aqua or Aqua-like? Make sure you list sites that have recieved ceast and desist letters for using ripping Aqua as if it was their own and for commercial gain. XP? Hello? We are talking about Apple.

    You're right, time will tell. I just wanted to let you be aware of the situation and what's happened in the past, the law decides on the resolution. I have no problem with that.

    The only problem I have is that I'm insulted that you are using Apple's copyrighted work (or insert anyone else here) for your own commercial gain. It's a sad excuse for lack of creativity.

    I am a little sceptical. I understand your objections. Although I have XP-like designs without any kind of objections brought by anybody. Maybe Macs have a community with better taste

    Let's remember iMac which was a copyrighted design. An attempt to create a similar (Windows driven) computer (I no more remember the name of the company) was stopped by Apple. The same or similar design applied to other electronic devices was not stopped by Apple. I am talking for example of modems, printers (Epson) etc. Apple knows that transferring their design to other, not competitive products, makes Apple products more popular. This is the case here too. Some end users will like it so much, that they will switch over to Apple computers.

    I didn't hide that the base source of this design is Aqua. And "inspired by" always means a big portion of making something after something else.
    If I am inspired by Mona Lisa and want to make a male Giocondo, it will look almost the same but it will be a man. Will this be a just copy or a new piece of art?

    Kosmo - just change it to "inspired by" and I'm sure you'll be fine. The worst thing that happens is you get a cease and desist letter from an attorney. They don't go after little fish other than ask you to stop, in which case you simply can't afford to battle the big-pockets.

    There are plenty of interfaces around that are "Windows-like", etc. My friend is a patent attorney, and this simply is not a black-and-white issue. They're all grey. The bottom line is that any large company can stop the little guy from doing anything because the little guy can't afford to battle them legally whether he is right or wrong.

    The practices of all of these large companies have began to disgust me so much that I think my morals and ideals are quickly eroding Good luck with it.
