5 servers down, 5 times account migration, no even 3 days site online. Refusal to pay money back. And ban of the client! I like to add, i dont receive the backup of the sql database and fresh copy of my site. That is a criminal theft!

5. 08 August the hongkong server has no scripts, they begin to install PHP, u can imagine, installation 3 days! Their boss ask me, what means GD libraries in PHP for capture code, he dont know :

6. 13 August 2008 the PHP currently installed, but the server has no speed, it loads simple page for 14 seconds! They say Migration to new server from hong kong to china, but the ip is from Malaysia:

7. The speed again slow, the page cant load till 19 August 2008
8. Today i open the site and see suspended page. they wrote to me :

I have contacted the owner and hopefully will get an answer soon.

9. i said to them, Account termination give me money back and they dont refund me and ban my client account. that is not hosting service , that are money swindlers, they dont understand the IT and networking, they have constantly porblems with apache and cpanel.

Sounds like you got really unlucky

If a Paypal chargeback doesn't work, you could even do a credit card chargeback, but that will make your Paypal balance go negative or in other words you wouldn't be able to use Paypal anymore without paying it back...

Weblexa is also a company with similar practices. They bailed on all their customers most of which had paid for a year or more, on the 15th of August and shut down all their customers websites with no refund.

Below is a copy of the letter I just wrote them.

Just writing you to let you know that as one of your former customers I will never recommend your company to anyone.

I'm disappointed in the fact that your company lacks integrity and is unable to honor it's agreements with customers.

After signing up for a plan with you guys, you shut down your entire web hosting server with little warning. You also kept my money after only providing service for 3 out of the 12 months paid. Your company offered no refund and at the last minute told it's customers to sign up with another company offering a level of service that is substandard to the previous one.

I will never put trust in your company again and I will recommend that all my friends behave similarly.

If you continue to do business this way then don't be surprised when your customers start registering names like weblexasucks.com because they're disappointed with getting ripped off.

UnderHost has a responsibility to protect each client and provide them with the best service possible. The following guidelines were designed to ensure that our services remain of the utmost quality, by preventing the actions of one client from adversely affecting others.

The Terms of Service (TOS) are the rules and regulations for using our hosting services. All use of our hosting services is subject to these terms. Please read them carefully and ensure that you understand and agree to all parts. Your use of UnderHost services implies your agreement with these terms.

End User Agreement

Customers may not sublease, sub host, or give away control of any portion of their UnderHost space and/or resources (including, but not limited to, e-mail accounts, space, ftp accounts, etc.), unless otherwise stated in writing.
Content

All services provided by UnderHost may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Australian Federal or State law, or any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless UnderHost from any claims resulting from the use of the service which damages the subscriber or any other party.
Examples of non-acceptable content

* Bulk Email related products
* Warez Files Hosting and/or Copyrighted software, music or video hosting
* Illegal material or material that is against public policy

Copyright Violations

UnderHost will respond to all reports of infringement that are formatted in accordance with the Digital Millennium Copyright Act and any other applicable copyright laws. We will act in accordance with the DMCA when handling infringement reports.
System Resource Usage

If we (UnderHost staff) determine that a customer's account is utilizing an unacceptable amount of system resources, we may temporarily deactivate the account in question. If we deem it necessary, an eviction notice may be sent to the customer of an offending account providing them with ten (10) days in which to locate a new provider. This only occurs in extreme cases.

UnderHost will be the sole arbiter as to what constitutes a violation of this provision. Because of the nature of this provision, each account will be considered and analyzed individually.
Domain Parking Circumvention

Any attempt to circumvent domain parking restrictions by using selective HTTP redirects or any other method to send traffic from parked domains to sites other than the main site is strictly prohibited. If multiple domain names with separate content are required the appropriate account type must be used.
Chat Rooms

We do not allow clients to install their own chat rooms. These tend to be large system hogs and we cannot allow it as a account option. Clients are free to use any and all of the three chat systems that come pre-installed on all accounts.
Background Running Programs (bots/daemons/monitors)

Customers are not permitted to run programs in the background on shared hosting servers. This tends to use a lot of system resources, and can impair service to other customers on that server.
Backups

UnderHost hosting accounts include a nightly backup service but these backups are for internal administrative purposes only, and are in NO WAY GUARANTEED! Customers are responsible for maintaining their own backups on their own personal computers. UnderHost does not provide any sort of compensation for lost or incomplete data in the event that backups do not function properly, even if the malfunction was due to negligence on UnderHost part. We will do our best to ensure complete and accurate backups, but assume no responsibility for this duty. Always back your site up to your personal computer! We make no guarantees about the availability of backups.

Data Loss
Your use of the service is at your sole risk. UnderHost is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on UnderHost servers.
Cron Jobs

We do allow Cron Jobs to be conducted on our servers. You can setup and manage the cron jobs for your account from the "Cron Jobs " section of Cpanel.
IRC (Internet Relay Chat)

We do not allow IRC or IRC bots to be operated on our servers. Any account found to be in violation of this provision will be immediately suspended and/or deactivated and no refund will be issued.
Shell Access

Shell access is not provided on hosting accounts. only on semi-dedicated, dedicated and vps.
Refunds/Account Termination


If, for any reason, UnderHost fails to deliver said services, a prorated refund will be issued. No refunds will be issued if abuse of our stated policies forces UnderHost to suspend or terminate your services prematurely.
In the event you request account cancellation before 14 days, a refund fee of 10$ was applicable for service if needed. no refund issued after 14 days. once your service has been cancelled your account will be suspended from use. It will then be deleted within 14 days. If for any other reason your account becomes suspended and remains suspended it will be deleted after a 14-day period.

NO REFUND ON ANY DEDICATED PLAN, WE CAN REJECT REFUND ON ALL TERMS ALSO
Unsolicited Email (SPAM)

SPAMing, or the sending of unsolicited email, from a UnderHost server or using a return email address that is maintained on a UnderHost server is STRICTLY prohibited. Using SPAM to advertise a site hosted on UnderHost network also constitutes as a violation of this provision. UnderHost will be the sole arbiter as to what constitutes a violation of this provision. Sites found to be in violation of our SPAM policies will be immediately deactivated and no refund will be issued.

Help us STOP SPAM! Please contact us immediately to report a violation of our SPAM policies. Don't delete the message - we will want to examine it.
Server Abuse


Any attempts to undermine or cause harm to a UnderHost server or customer of UnderHost is strictly prohibited.

UnderHost will be the sole arbiter as to what constitutes a violation of this provision. Customers found in violation of this provision will be subject to account deactivation without refund. UnderHost will turn all available information about abuse incidents, including customer contact data, over to the proper authorities and press charges.

Resource Usage
Use 21% or more of system resources for longer then 90 seconds. There are numerous activities that could cause automatic supension; these include: CGI scripts, FTP, PHP, HTTP .:.(Virtual Hosting).
Account Setup / Email on file

You agree to not use excessive amounts of resources. Any violations may result in us taking corrective action in order to maintain server stability by killing any processes, disabling and/or suspending your account. Shared hosting accounts may not use more than 3% CPU or 3% memory over a 24 hour period, run more than 24 simultaneous processes or allow any process to run for longer than 45 CPU seconds. Databases are limited to 24 max user connections. Semi dedicated/reseller hosting accounts may not use more than 6% CPU daily, run more than 30 simultaneous processes or allow any process to run for longer than 60 CPU seconds. Databases are limited to 30 max user connections. We do recommend to take this customer to one of our VPS or dedicated server plans because the huge amount of bandwidth and resources this site is demanding.

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times. Providing false contact information of any kind may result in the termination of your account. In dedicated server purchases or high risk transactions, it will be necessary to provide government issued identification and possibly a scan of the credit card used for the purchase. If you fail to meet these requirements, the order may be considered fraudulent in nature and be denied.

Transfers
Our transfers team will make every effort to help you move your site to us, however, we can not make guarantees of the transfer process. We provide this as a courtesy service and can not make guarantees regarding its availability or the amount of time it may take as each host is configured a little differently. We will try our best, however, in some cases we may be unable to assist you in a transfer of data from an old host.
Failure to Follow Policies

Failure to fully comply with these terms is grounds for account suspension and/or deactivation (with or without refund at UnderHost Server Network discretion). Any accounts and/or servers contained within UnderHost Server Network must adhere to the above policies.

We reserve the right to remove any account without prior notice. If we deactivate your account for violating policy, you will forfeit your rights to a refund--and none will be given. No refunds for advanced payment. Our normal policy is a warning first, and account deactivation the second offense, but no warning is required.

UnderHost Server Network reserves the right to deactivate and remove any site hosted on our servers that contains any content that it deems in its sole discretion to be unacceptable, undesirable or contraindicated.
