Just rent a server in a country other than the US and you should be fine depending on what you are using the server for; I saw someone who posts here who specializes in offshore servers; unfortunately I forget their name or website.

That would depend on the laws in the country where the servers are hosted.

How can you write such thing? This is just not right!

    - In Netherlands, I had some (indirect) contacts that got busted because running some ftp sites. They allow adult content, but that's about it.

    - What is that country "Chinia"? Did you mean "China"? I live in Shanghai (even though I'm French), and I am considering to open a hosting company in here. I can tell you that the regulator here are quite strong, and that they wouldn't allow such illegal sites, especially if it's to serve foreign visitors.

    - In Sweden, it's allowed to run sites such PirateBay because they DON'T host the content, only a tracker.

So pretty much none of the countries you are talking about allow piracy.

    Hi,

Thmoas pretty summed it up. You really do have to factor in where the sites are hosted in contrast to where the content is hosted. If content is hosted across the world on some sort of network of say torrent seeders, rather than a tracker solely in Sweden, there's no real punishable offense from the US point of view.

From the USA point of view, even hosting a tracker can be enough to sue.

I can't agree you. First, in Netherlands, every DC have different policy and I believe that there are some DC allowed to run ftp sites.

And second, China law is very complicated and different with Western culture. You can not totally believe the words printed by the law, law is just a government tool. No one will fully believe it here. If they just don't care you, then no matter what are you doing you will be fine. Otherwise, even though you don't against the law, they can still jail you with whatever reason they like.

I'm not going to pretend a specialist but the answer is you will need to find out what the government like or not like at this time and the law/policy sometimes is frequently changed/updated.

Take adult site for an example. Indeed, the law clearly say that all type of adult contents aren't allowed but no one would care about it until the government said, all adult sites need to be closed this year from Jan to Sep because of Olympic 08(photos/vids that aren't really adult like some normal hot girls seems still allowed).

The regulator is really super strong but they are aimed to control the speech of freedom rather than the law of property(like warez). There are still plenty of warez in China now.
