I just left a fair sales position due to my involvement in a business with "like product/service". I thought of finding employment within the hosting industry. I am unsure if my previous conflict will carry over, but I could assume it would.
Is there something wrong with learning from the competition? In the past, I have signed terms of employment that prevent my use of any learned information for a year after employment has ended. Is that policy generally used?
I think thats silly. I think so long as your able to do the job to the best of your abilities you should be able to apply for as many as you like. Especially in the hosting industary where there is something like 50k businesses.
In my opinion if you can do your job well and taking on another job doesnt affect your exsisting one then it shouldn't matter in the slightest.
But should I make it obvious to my employer. Although I know it shouldn't make a difference as long as I am dedicated to the business I'm on the clock at, it did at my last job.
My last position's conflict was in a completely opposite department/division than I was working in, but it mattered. If I am to be employed with a web hosting company I think it may be even more of a concern.
As an employer, I would never hire someone who works for another hosting company. It is certainly a conflict of your interest.
All our employee's are required to sign a non-disclosure and non-compete, and also an agreement that says they will not work for anyone else in the same industry, including themselves.
But then... we pay pretty high salary's so our employee's don't need to work for someone else since we keep them happy...

Yeh - If you have to sign a non-compete act then you most deffo can't...In UK law your original employer need never know LEGALLY, though it would be curtious to tell them, however your new employer MUST be made aware that you:
1) Already have a job (Part Time/Half Time/Full Time)
2) It is in direct competition with them
This probably applies for the US also however you will need to somebody from there to get a more detailed answer.
May be the question to siforek is whether he intend to have his own web hosting business now while working for another hosting company? if so then I think it will be a conflick of interest. otherwise, no..
we gone through life learning a lot of different things. .you cannot use the contact from one job to use another if it is in the same industry.. no problem if the customer come looking for you though.. so the knowledge you have cannot just disregard in the present role..
example.. you learn how to flip burger in Big M and then u gone to Burger King, are you then prevented to do the burgers? i think not.. or can't do them when you doing a BBQ party at home?
I think it's going to purely depend on the employer, and because of that you should disclose your intentions when seeking employment to avoid a potential bad fallout.
I have a "day job" with a web hosting co-location company, on the side I also own and operate my own small co-location/dedicated server management company. I do so with the full knowledge and support of my day job employer.
I think my employer fully understands that turn over is going to happen. His concerns as an employer aren't just limited to making sure that the job gets done, but things that he can do to help his employees grow as people. Things like providing educational tuition reimbursement and encouraging training. I'm sure he fully realizes that at some point employees will grow to the point where their capabilities exceed the job function required, at which point they might be offered a bigger position or they might move on to other opportunities. Me operating my own company is more something he sees as things I'm doing to ultimately better myself.
All that said, we do have some simple "common sense" agreements in place... ie I won't provide services to his customers, and I will be clear to differentiate my services under my own company name.
I say no problem as long as you keep the two separate. Don't try to tout your own service while working for them, and you should be fine. For instance, I have my own hosting company, and work for another as a support tech/sales help. During the time I'm working for them, I'm devoted to that job. No "cross selling", or anything remotely related to my own business. They are fully aware of the situation.
That may be the key then: full disclosure to the hiring company in advance, to avoid misunderstandings.
I worked for quite a decent stint for one of the well known (and well thought of too, I must still say!) hosting companies on this board, while still running WebOnce as well. In fact, WebOnce was already running (and they knew about it) before a job offer was ever extended.
We discussed the possability of a conflict of interest, and in my time there, I think we may have had two issues regarding it... one was that I had befriended one of the clients and showed him something I was working on at some point (I don't remember what) and ... I never took them on as a client or anything, but I remember a bit of conflict over this, which is understandable and should ahve been a 'duh' on my part. The other was ... actually... an amazing convience.
We had one of our servers through the unmentioned company, and someone had come in to report a copyright infringement ... by one of WebOnce's clients on WebOnce's server. That was pretty funny, and everyone was happy because it got delt with right away.
Really what I'm saying is... be honest. If there is a conflict, say so up front. If you think you can handle things properly without the conflict interfering, say so. Not everyone will turn you down. Some may, and that's up to them, but be honest and you'll win in the end.
