    This is not his first design sold here (specially to me).
    Each original designer will have certain elements that make his work "his"... this might give a perception that the design has been seen elsewhere where in fact, you might have seen the heart of the designer in other works that he created in the past.

    Thanks for that reassurance TCP/IP warrior. The only design I know of that is similiar to this one is another design I have done recently, however nothing was borrowed from the previous design and put into this one. This one simply follows the same main color scheme.

    When I do designs I take care to use my own color pallets, icons, etc.. that I have built specifically for doing templates. This along with my own sense of style ends up with my designs generally being easy for those that know me to point out, but not similar enough where people would think any one site is a copy/inspiration of another site.

    I think the design that you're thinking of is: http://zoodia.com/060.jpg (shown with watermark). The current design for sale was started at the same time as this previous design, but put aside due to other commitments that required attention. The headers and background are similar, but that's about as far as it goes IMHO.

    That design (the one linked with the image) was created by me as well (for any that didn't realize that).

    on the one had i DO agree with you there but on that last point

    but the first point you made is an obvious copy and paste and shouldnt be allowed!

    Sadens me to see you posting that marengo as I've recommended 4design.tv on multiple occasions for work that I felt I was either not qualified for or didn't have the time for. I feel as if you are jumping to conclusions a bit fast but I can understand and accept your concerns.

    We'll start with the header that you seem to assume is stolen (for lack of a better word) from one of your designs. The similarities that I assume you are alluding to would be the curve and the bar going across the middle. Neither of which were taken from your design that you had linked. I have looked at countless other web designs both from design firms and live sites. The fact that I used a similar curve and a bar within my header does not in my opinion constitute a pull from your design. In fact the content within my headers even differs completely from that which you used in your header.

    The curve on the design in question within this thread was decided upon after I had been looking at my own portfolio and came across the design that you linked to second ( http://www.zoodia.com/portfolio/imag...folio_ss/1.jpg ). That design was in fact done back in April as you can see here: http://webhostingtalk.com/showthread...ghlight=zoodia and it was done several weeks before then. I am not sure of the date on http://www.4design.tv/experiment/ but I don't believe I had been to 4design.tv at that time (understandably that's simply asking you to take my word which I am sure you are not a fan of at the moment).

    Moving on from that we come to the claim of a copy and paste off of the bars that you used http://www.4design.tv/forum-rank/index.htm

    First and foremost there is no copy and paste. As I have said many times my designs are my own work and done by hand from scratch. I have put up my own image to show the layers used here:

    which I hope gets rid of the claim that I went simply copied your image and used it as my own. Now as far as how the looks go I will openly admit that they are quite similar. I have blown up a picture of two of them together and put it here: http://zoodia.com/buttons.jpg

    (Don't ask why I named it buttons, not thinking right at this time for some reason and too lazy to rename it now).

    As you can see there are quite a few differences:

    * The gradients on both the blue and orange sections are different.
    * I used my divider all the way up the image
    * I used a two pixel outline around everything.
    * Mine use a dropshadow underneath.
    * I went with a complete rectangle where yours are broken.
    * My gradient on the blue is a simple bubble out type where yours is made to look like it goes to a point.
    * Mine go all the way across my sidebar where yours seem to have a black bar that goes behind them.

    I may most certainly have been inspired by the use of your bars on the design that you listed, but at no time did I directly try to copy them to my own. I will happily change the current design for sale to reflect a different graphic for the side bars in order to appease you as I can understand the argument.

    Well that is a wall of text, will get to work and put in new graphics for the headings on the sidebar of the site.

    MostarDesigns, sure shapes are not copyrighed. Ideas also. Nothing. And I'm pretty happy if someone is soooo inspired by our works. As I said before: we generate ideas and someone can redraw our works. Just don't tell "I'm a web designer" ops: And don't copy so stupid details. Looks funny

    I can also agree that they do look very similar. I demonstrated as best I could that they were not a rip; however, there is no way to prove such a matter. For that reason I changed the images used on the left side (which should be showing for any that refresh their view of the design for sale).

    The folks saying that this design is a rip are reaching. Terribly reaching. In no shape or form is this design an exact replica of what's being used in the examples provided. A "rip" by definition is when an image, code, design, or a layout is swiped. That means copied. aka cut and paste. Where has Dollar done this? Unless you have a true case for a rip, I recommend just keeping out of the sale. If his design was inspired by a design that you did, you should be flattered so long as nothing was ripped.

    Dollar, my offer is $100 if you can agree to hold this design until 12/22
