the process of PID is always arround: 99
I think somebody is using HTTPD to attack another server...!
I am not able to kill the process...
what shoud I do and how to catch the abuser??

In many cases it's impossible to "catch" abuser. Just make sure your server is optimized and secured by professionals. If you havent' done this yet - check rack911.com for example - they have affordable security package for most linux distros.
