Here's what you'd do: figure out what you did wrong, and fix it. I've looked a number of penalized sites, and in every case the reason was obvious. Most frequently the most obvious problem is keyword stuffing, generally with hidden text; next most frequent problem involves artificial link networks. The point is, if you get penalized you'll almost certainly know why. Correct the problem.

Then go here: http://www.google.com/support/bin/request.py

Choose "I'm a webmaster inquiring about my website," then "Why my site disappeared from the search results or dropped in ranking."

Give a clear, professional explanation of what happened and why, and what you did to fix it. Keep in mind that Google's webspam people know what they're doing, they've seen it all, and they've heard it all. Once they have you nailed, you're not going to be able to snow them... and you need them a lot more than they need you.

Best bet is never having to go through it. Keep it clean.

Offhand I can think of three ways that have resulted in my "finding" penalized sites: I've had potential clients make contact because they've suddenly had a huge drop in rankings or can no longer find their pages listed. I've seen posts in various forums from members experiencing the same things with their sites. And I've read discussions in various SE-related blogs and forums of specific, usually high-profile examples. For example, here's a penalized site:

http://www.traffic-power.com/

By the way, Google is currently running two different tests involving ways of notifying site operators that their sites are being penalized. One involves email notifications, and the other is through the console in Google Sitemaps (so obviously will only help people who use that service). Again, they're tests so not everyone gets notified of a penalty affecting them. And it's not likely that it will ever be the case that everyone gets notified... they're only interested in giving that notification to people they think innocently violated a guideline, not those who do it on a large scale or who clearly knew what they were doing. That is, I'd be confident that the above site wouldn't be notified.

One more thing: if you look at the site linked to above, you'll see that on the client's page while the wording "this site" is in place where they used to link to selected client sites, they no longer do so. You'll also see that the "presentation" is no longer available. That's because not only this so-called SEO firm's site penalized, so were their clients' sites.
