Employing someone residing in another country


I see that this trend is getting quite popular.

Eg. you employ a coder in Spain and a web designer in UK.

What's the legalities involved with this approach? Do you just make payment to them on contract basis? or are they considered to be on your payroll?

They are only your employee if legally registered as such with a contract of employment. If you just pay them occasionally (or regularly), then they are subcontractors. If you're really in doubt, go see a lawyer.

Subbies are the way to go - you don't have to handle their tax, benefits, holidays, etc etc. You just ahve to handle their invoices. simple.

If you are looking really spanish locales, www.laboris.com is one of the best sites to start for latinamerica & spanish speaker countries

Although I suspect you where just using that country as a sample... My best bet is that you want an Indian coder, a UK designer and a finally take Spain holidays?

yes i too recommend getting someone in another country to work for you without going through any legal stuff. you can do that. most of the time you only pay them for every job they do and like mentioned you dont have to do all the extras like you have to do for a employee.

rentacoder.com is good

I just paid a translator for a small job and it all went very smoothly. I found her via www.elance.com and am very satisfied with how it went. Generally you can sense whether you can trust the person or not and i find it easier to subcontract a job rather than to legally employ someone on a temp basis.

If anyone needs some trustworthy coders I can recommend a few of our customers. One in particular offers a dedicated developer service as well as other forms of outsourcing and is based in India.

If you are hiring them from a trusted freelancer site I dont think its a big problem. Alternatively if you want to hire a coder from other countries obviously you are going to ask them to give references that you can trust on. BTW, I would suggest to get legal contract with a coder with signed NDA before you assign them a project.
