Im StarTing a hosting Biz Do I need protection (a lawyer, insurance)Can myclientssue?
Hey I am thinkin of starting a webhosting business... The only setback is, will my clients sue me. Say my server crashes and it looses there data can they still sue me if even in the liscence agreement it states i am not responsible for lost data? Do I need any insurance or is there nothing I have to worry about it.
Your "terms of service". It wouldn't hurt to consult with a lawyer and have these things drawn up legally in the first place to prevent any future problems. You wanna address things like a client not paying, a client abusing services(ie: spam,trojans,etc.), uses of mail, whether or not you will accept pornography on your servers, etc., etc.. Do your homework, write it out and go pay a lawyer a few hundred to write it up where it will stand up in court
edit: Are you in the US? If so you can go with a LLC and protect your home and other personal belongs from being taken if someone did sue and win.
Yes, I am in the us and I have written my terms of service... the only thing I am worried about is a client sueing me for losing there data or something by accident even though I would repay them. If I promise to pay in any situation that I screw up and they brake the agreement do they still have the right to sue

CLIENT shall indemnify, defend by counsel reasonably accepted by PROVIDER, protect and hold PROVIDER harmless from and against any and all claims, liabilities, losses, costs, damages, expenses, including consultants' and attorneys' fees and court costs, demands, causes of action, or judgments directly or indirectly arising out of or related to the web hosting and other services provided by PROVIDER to the CLIENT.
