Stay away from EV1 (No ethics)
Hey Everyone,
Ev1servers.net does not care about ethics and allows their customers to rip off copyrighted content from customers of thier datacenters.Synergy Blue LLC

I have sent 3 emails to their Abuse department regarding the following site:

Have you done it in the standard internet DMCA filing way? They are more likely to deal with it than if you just e-mailed "They stole my images! FIX IT NOW!!!"
This is taken from ThePlanet's Legal Documents, but it's pretty much what all decent datacenters expect to receive in regards to legal copywrite infrigements...
It must be a written communication;
It must be sent to the designated agent identified above;
It must include the following:
A physical or electronic signature of a person (“Complaining Party”) authorized to act on behalf of the owner of an exclusive right that is claimed to be infringed;
Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
Information reasonably sufficient to permit the service provider to contact the Complaining Party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;
A statement that the Complaining Party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
and

I gotta be honest, just about every single data center I ever contacted about someone stealing content, were completely unhelpful. This goes for EV1, TP, and a bunch others.
Unless you basically bring them a Cease and Desist, or threaten to sue them... it seems it won't get resolved. I once had an ISP host some site that 100% completely copied ours.. even down to the logo with our name on it! We contacted them a few times.. very professional and all. I emailed Mario. we have been complying with other DC's request about copyright, and it usually gets resolved in 24 hours. It's not fair

EV1 is doing the right thing - protecting their customers from frivolous and nonsensical complaints. If you had structured your complaint in a more clear and official manner, and offered conclusive proof that the site was yours, then you wouldn't be in this predicament.
I would hate to rent from a DC that ducked and covered every time a legal threat came in by pulling my box until I could counter that claim.0

I don't think it's the idea of ducking. We have handled complaints for a number of complaints against our clients. Most of them are resolved as it takes time for each party to present evidence that they hold legal copyright of the content.
I honestly don't think any DC will duck and unplug servers, they would lose money and clientele.Synergy Blue LLC
