What do you do when you get a spam report? Instant termination or suspend it and hear out their side? In this particular case I have verified it so I locked the server and I am thinking termination is the only way. Anyway after beeing notified of some spam I checked and I found a program called dark mailer running. Here is a screenshot.
What I am wondering is after all of this would it be unethical to teminate the account without waiting on him to put in his side of the story. I have noticed the software before when I went in to troubleshoot and he assured me that it was an opt in mailing list. Then I started getting complaints and when I logged in I found it running. And judging from the message I can't imagine anyone would OPT In to receive this. Please give me your opinion.

Don't terminate him outright. Chmod the application to 0000. Email him explaining what was found and ask him to explain his actions and what he will do to insure that this never hapens again. Tell him you have a zero tolerance policy for sending SPAM from your servers, and that should you decide to give him a second chance and it happens again, goodbye.
That is how we handle it anyway. Seems to work well for us.

Would it not be better to use one of the above solutions such as chmoding the application to 0000 instead of taking down the entire site as a result of suspension?

If you haven't noticed it seems to be a dedicated windows server?
Pull the network cable.
If they apologize, a LOT, then MAYBE plug it back in. Otherwise... no way.

i send a mail to the customer warning him of the complaint and requesting an explanation, i also advise that if the explanation isnt satisfactory or any more complaints are recieved then to look elsewhere for hosting.
I also cc in the abuse email addy of my dc so they are aware of my actions incase any complaints go direct to them.
If you keep them in the loop it keeps them happy and less likey to do anything rash if the get a spam complaint direct
