    even with backup would you still said...

    we are not respoinsible for your data...or something like that.

    would it be better to have a clause like that in your TOS/AUP?

    Yes ofcourse! You never know when something extreme happens or when 200 customers suddenly want backups. Good to say backups are for our use only in the event of distruption of service and not at the users request. However we are not responsible in anyway for maintaining backups etc etc...

    It depends on what you want to do. I do daily backups and I provide them to the customer. However I am not reponsible for them

    It depends on your target market and pricing scheme.

    Generally around here it seems most people provide daily backups, but don't guarantee them.

    We have a clause in our service agreement that says we can not guarantee backups, even though we provide nightly backups.

    I wouldn't take that clause out unless I was 100% sure that if disaster strikes that those backups would be around. Right now we're using a NAS provided by the datacenter for backups. No guarantee they would survive if something bad happened to the DC.
