yep, best way even though it may be expensive, but shop around and ask if they've done this type of work before.
If they have it should cut the time spent on you explaining everything and your final bill!

Contact a lawyer, look at current popular hosts TOS. Possibly download a template to get you started.

No need to contact a lawyer really. All you have to do is think about every possible event that may happen, and include it in your policy. As well, you should write it as if it's the law of your company that you will follow. Every single situation, or guarantee you offer should be included. Feel free to PM me if you need more help on doing this.
There is no need on paying a lawyer when you can do it yourself.

You need to consult your attorney and then you can draft the copies of your own TOS, rather than picking up from any other web-site.
