they look nob all like each other apart from the blue bit at the top, and surely you can't copyright a blue bar....

That is a really close call... However I doubt rackspace would copy a design?

Thats a total rip in my opinion. The sylesheet is nearly exact and if they cannot even make some good text, I dought they can make this layout themselves.

Copyright over something is automatically generated. You don't have to include a notice at the bottom of the page.

Althought the site may have not been totally ripped, the layout scheme/colors are pretty heavily "inspired"...if you even want to call it that
