Is it capped on 10 Mbps or burstable with an average of 10 Mbps?

That would be your choice.

Some of our clients elect to have their port capped @ 10 Mbits so they don't incur overage charges. Otherwise you are allowed to burst upto the limit of the 100 Mbit port. Overage is billed at $0.75 /Gig.

Pretty interesting.

So if say I have 9 Mbps sustained, but peeking to 12 Mbps will I face an overage?

Well, if we cap the switchport @ 10 Mbit/s then you in theory can only transfer no more than that limit. Be aware that 10 mbits sustained is about 3240 Gigs aggregate per month. If you go over this limit, then you would be billed for overage.
