Domain name stolen: Advise


We received a new client yesterday who wanted to move their domain name and content to us. After speaking with his old host they said they would not release his domain name or content. They even logged onto his account and changed the registrant information and admin contact so he was unable to make changes.

The domain registrar is opensrs.

Any suggestions would be great. Opensrs said only a lawsuit would fix it.

Not an attorney but will attempt to help anyway.

You mean your potential client registered the name with that old
host or the registrar itself, Opensrs? Or someone else registered
it for the client back then?

Unfortunately Opensrs may be right: only a lawsuit can fix it as
there are little to no laws defining the scopes and limitations of
this otherwise irritating problem.

Your client basically has 2 challenges:

1. To prove he indeed owned the domain name and never ever
authorized any changes.

2. To prove the old host or whoever else made the unauthorized
changes.

Your client could use the UDRP, though it depends. What content
does the name currently show?

Too many factors to consider...

Does he have a reciet on the domain name he paid for? Also who is the hosting company that is not allowing him to leave? Always nice to throw complaints to whom ever you can in this case.

I'm not sure what happen but if you are to move your domain name, basically you initiate a transfer from the new registrar. Then your client should be contacted and confirm the transfer. If the domain is locked, he has to unlock it first.

OpenSRS is Tucows reseller program.
Is this OpenSRS or a company that is a reseller of OpenSRS?

FYI: OpenSRS is Tucows. Unlike eNom, they do NOT sell domains by themselves, not even at higher prices.

You might need to go down the UDRP route. many registrars will not get involved in disputes
