Client disobeyed TOS. What should I do?
A client of mine has infringed the rights given to him in the TOS of my company. What action can I take? What do I do? This is a billing related issue...

Well, it depends on the violation and your TOS... Either reprimant the user or kick 'em off your servers.
Checkout www.crunzh.com for nice freeware programs. Including a program for monitoring your webserver.

Why do you have a tos if you don't want to enforce it?

Well, the question here is I have a TOS, but am not sure how to enforce it, besides having the client check the box when they signup for a service . How must one enforce the TOS?

We still need more information.
We can't advise you with what you've supplied.
Although you said it "has to do with billing," I don't know what that means.
Does it mean he didn't pay you? Then you invoice him and give him a deadline.
Does it mean he wants a refund? We need to know your refund policy.
We need to know something other than, he violated your tos.
I'm not sure you need a TOS if you don't understand it.
Perhaps it's a good time to re-evaluate that Business Plan you were going to put together.There is no best host. There is only the host that's best for you.

Well, there is a cancellation period for a service which he has failed to cooperate with. He has decided today to cancel his service, billing day being tomorrow.

Do you not bill in advance each month? If so, and he's not bailing without paying for the past month, suck it up and terminate his account, not much you can do about it.

Typically when this happens I package their files email them with files attached refund their most recent payment and immediately terminate the account. Unless it's a mild offense then I usually work with the client to correct the problem. Unless I know he lied to me at which point see what I said earlier.

Being overdue on webhosting it not a big deal, under my consideration, unless it's a big account. I am talking about dedicated server services.

I don't think the size of account really matters .. I think it boils down to the problem of .. "Do I need this customer more then he needs me" ... if you need him more then give him a warning and reconsider your strategy as you can not fall over from one client ... if you don't need him then in a nice and professional way kick his in the butt and don't let the door hit him on the way out ...
