Huge Dillema here!

Hi guys!

I was just seconds from purchasing a domain for 1600usd (lets call it xxx.com)

anyways just before making the transaction i noticed xxx.co.nz was taken and already set up as a hosting provider!

This screwed my plans up! I wanted to operate a xxx.com and xxx.co.nz (new zealand is my local area). And run these under the same website.

I checked a list of companies and noticed there is no such company trading under xxx in new zealands.

My plan is to register myself as a company by the name of xxx which will work fine for my .com merchant account.

I will then register a totally different domain name to target my new zealand audience lets say yyy.co.nz

could i operate under yyy.co.nz with the company name and merchant account of xxx?

I beleive i will just have to warn my customers that they will be billed under xxx right?

This is a huge ammount of money to me.

Thanks for your time!

If you put on invoices "this charge will appear as xxx on your credit card statement" you should be fine, you could also promote the xxx name with a yyy new zealnd domain name

If you are sure that whatever.co.nz isn't a registered company or trademark. next, since you registered your business ask them to change their name. as they used your business name in their domain. May this work.

I beleive i will just have to warn my customers that they will be billed under xxx right?
Correct.

Hey Nilomedia, I thought the same thing! Problem is that they registered the .co.nz before i will have the chance to register as xxx company!

What are the chances i would win a case like this?

Heres another theory i have...

Wont i need to purchase a seperate ssl cert for the 2nd domain?

An easy solution. Change your name! Since you seem to be a new player and also didn´t do any image-branding yet, why going into so big trouble? You can save the 1600 USD + eventual problems with the other company.

I know this, but this name I beleive is something really special. At the moment i have made a bid for another domain.

Not as good as the original domain, but we will see what happens!

You can run both companies under the same merchant account. Make sure you state both company names for your offshore merchant account processor so that they are included it in your merchant contract with them.

Also make sure on your invoices that you state the descriptor name your client will be billed from so that they will not be a surprised when they receive their statement and it says xxx company yet they purchased the services from abd.co.nz company.

Try to find another brand, and sell your current xxx.com for something around $1600. make sure the lose is little. this way, you save $1600 and get your own new brand name. While you get rid off any future problems in the cross. (just opinion)
