    Beware Of Hosts!!!

    I GOT SCREWED OVER.

    I gave them $290 and asked for it back. They spent it already. And will not give it back. What should I do?

    These are the companies that im dealing with in this situation.

    I have a contract that I signed with them that didn't say anything about a refund. They claimed I signed a 7 day contract. On the 8th day I requested a refund due to server being down 5 hours, DNS servers not setup properly, and them using illegal software on their server.

    All contacts were through AIM
    whmhst - told me to contact person below
    DeJay007 DoT CoM - owes me $50 (probably in highschool)
    TwiztinUptheMind - said he owes me $120 (is in highschool)
    WWNETDave - said he owes me $120 (no clue)

    Last 2 suposidly split the $240 I paid.

    The last 3 "own" the server I sent cash through paypal. I have 2 REAL names.

    Looks like he used his real address. WOW he is VERY close to my location. Maybe I will call his parents.

    But that is the current information that I have. If anyone else can help me out, please do so. I could use stuff like parents names so that I can get a hold of their parents and make them pay.
    Also, my site, verticalhost.com may be on that ip but I dont owe myself money

    Well I don't know.. some providers have been in this business a long time and customers can feel safe paying them a year in advance, specially in a situation where you have a discount like 2 months free of hosting.

    In any event, I'd give any new provider a few months of a 'trial' before committing a prepaid term with them. Any.

    If you're still as happy as you were the day you signed up, prepay then.

    Contact the credit card after trying paypal. Note to paypal your intent to get a refund, but only use the CC chargeback option as a last resort.

    As far as highschool kids names? Don't think you're gonna get it here. Someone might surprise me though

    how do you know they are in high school?

    dont threaten paypal that youll charge back your card if they dont cooperate, theyll shut you down for that.

    On top of all that, highschoolers (those under 18) aren't supposed to have access to PayPal accounts anyways.

    If you really want to get even, tell paypal that a kiddie-host is using an account; they might freeze it, just for fun.

    I didn't say anything about a charge back.

    But I did put this

    I contacted my lawyer about this issue and he suggested that paypal handle this dispute.

    I only put that because it show about the complaint form that the seller receives a copy of the complaint I sent to paypal.

    I am in hopes that would scare them a little.

    It will take paypal 3-5 days to contact me again.

    WHM-Host use to be LeamHost.com. LeamHost.com said they "sold their company" to WHM-Host.com, but when infact the owner of WHM-Host.com IS the owner of LeamHost.com

    first off no one has established that these are highschoolers

    secondly, what exactly WAS the problem here to warrant a refund? a little down time? did i miss something?

    third, you people here are INSANE to suggest to others to try and get peoples paypal accounts shut down. dont mess around with peoples businesses like that. you have NOT heard the other side of the story, but i WILL be contacting the other party to find out whats REALLY going on.

    something here isnt right.

    one more note, when you start mentioning lawyers, the conversation is OVER. they will tell you to piss off and have your lawyer contact them.

    take a look at the guys sites that he said screwed him over!

    they are VERY nice (although templates) sites and they have an active forum board.

    Our members have made a total of 3 053 posts
    We have 370 registered members
    The newest member is zerolove
    Most users ever online was 15 on Apr 4 2004, 12:56 PM

    they do NOT sound like scammers to me, although i could be wrong!

    Im sorry, you must not have read my first post FULLY.

    Go ahead and contact them, i'm sure they will say something completely different. Isn't that what people do when they dont pay you back, make excuses? I wanted a refund because of the illegal files on that server, a 5hour downtime in a 7 day period, i asked for nameservers to be setup and was never done, an average server load of 115.56, and very unprofessional service and support.

    That is not my server. That is there server that just so happens to host warez, and use an illegal copy of WHM autopilot. I contacted the owner of Autopilot about this and he will deal with that appropriately.

    That is there server. I just got a new one setup recently with Host-Us.net you can contact him if you need proof. Or just goto http://65.75.189.50/

    WHM-HOST referred me to these guys because they said they were starting up a 2nd server and they thought it would be a good idea to get on that one. He was wrong. So in all, they screwed me out of money and I want it back. And I wont stop until I do.

    I'm tired of seeing people get screwed over by so called hosts. Do a search and find out.

    Oh, and I have talked with them on AIM and they said that they were in highschool.

    all i know is someone appears to be hosting an illegal DL of whmautopilot!

    MAYBE WE SHOULD REMOVE THOSE LINKS TO THE APPARENT WAREZ COPY OF AUTOPILOT???

    I think that the only kiddy here is vertialhost, I think thatís he purchased the account and then decided he didnít want it and found that he would use the 5 hours down time as an excuse to say he wanted his money back, I am on the server he is on and I never remember a 5 hour down time, I find it strange that he says the dns is messed up when it works perfect for me, server speeds are also fast all the time, I just think that he wants his money back because of his own mistake of buying something too fast witch inset really a legit reason, I have 20+ people hosted on the server he is saying inset any good I find it strange that has the only one with problems, and btw I thatís just stupid for reporting a site with WHM Auto Pilot because your feeling pissy today. Come on grow up stop complaining and blaming other people for your bad choices.

    And on a side not I would like to say that if we want to get all legal here, putting minorsí names on something without there parentís permission is against the law I believe.

    Seems you need to refund him to me. You have no problem stealing software, so you probably have no problem stealing money too, so I won't expect you to refund him, especially with that attitude you show.

    Thanks amd_duron. It's hard to get people to believe you. I appreciate it.

    As for warezhost, aka aimsn: dejay007dotcom, he sold me the account. I had to paypal him $50 and his friend $240. I have yet to see that. So when should I expect to get it?

    This would easily be dropped when I get my $290 back.

    I have contacted a lawyer, paypal, and the developer of WHMAutoPilot. I don't like people stealing period and that is EXACTLY what you are doing.

    No offense, but almost every single customer who mentions their lawyer while in a fury never does anything with them. I've heard tons of stories about very angry customers saying, "I'm suing because you won't give me my $1.27 refund... You're gonna regret this."

    Your claims may very well be substantiated, and you may not be complaining about a pittance. However, 99% of the time, customers only mention their lawyer in a fit of fury. If you're really angry, you may to calm down in order to think rationally.

    He is not getting ripped off. He accepted the Terms of Service I sent him thru a instant message on aol instant messenger. I also gave him many options, if he didn't like that server I could give him his own dedicated server. We could of even put him on a server in another dedicated server. He requested the refund after the 7 Day gurantee. So that means he accepts the service and would continue to use it, as stated in the Terms of Service. His account will stay on there for as long as he payed up for which is 2 years. We were helping him out we sold him really cheap hosting with a reseller, but does he recognize this? No. I doubt anyone is going to believe us about this. But you can believe what you want we never had the 5 hours down time like he was saying, this is all a lie. The conversation he posted wasn't even full. He forgot to mention he was lieing that he gave us a Terms of Service when he signed up for the hosting. Verticalhost your account is still up, you have caused alot of grief over nothing.

People don't want to be on a server with warez for one, as they can and shoudl get shut down by the FBI at any time, you aren't doing legit business, don't expect legit customers, and give the money back to the ones that thought you were legit. I will admit I woudl never go through with such a funky payment arrangement, nor would I pay for 2 years upfront, but you aren't getting anywhere defending your piracy and theft.

    Who said anything about warez being on the server? If I find that there is warez on the hosting there accounts will be terminated immediately. We are doing a legit business. We also gave him the option of a new server or another datacenter. How is it piracy and theft? Everything that runs the server is fully licensed. WHM-Host has nothing to do with this also, I don't even know who hes talking about i've never met that company. Its starting to seem like he is doing this just for advertising for his site.

    I had a little chat with our boy, and let me point out the highlights.

    1. He would of given him the money if he didn't bring the matter to WHT and ruin his reputation.

    2. He stated that if he was sued, he would bring up how illegal it is to post a minors name in a forum.

    3. He stated that he is not the owner of the company. (What he really is, I do not know - but he claims to not be the owner).

    4, I told him that if he claims to not be the owner, he should post it on here with the real owners name, address, phone number - anything.

    5. He said he will do that in the morning, it was his bed time.

    It is important to note that he contacted me for advice on the subject, I did not contact him. Also, for clarification - this was Mr. Twisted Mind (AIM). Now, my question - When he stated he would of given him the money if the client didn't bring the matter to WHT and ruin his reputation. He is refering to himself as he was the owner, however later on claims he is not.

    That was the kid's claim, that he accepted the TOS. The clients claim, is that AUP. Which overrides which? That's the question at hand.

    I would say that TOS overrides everything. I asked our lawyer and he agrees. That's in Canada though.
