    Flattered? Heck no.

I've seen a few beauties in past threads here, but this is a little disappointing. I'd like some advice on how to proceed.

Found this in my logs tonight...

    My site:
    http://www.charlottezweb.com

    Webonixhosting.com:
    http://www.webonixhosting.com

He didn't bother to change but only a few text parts of the entire site, whereas the rest is there -- even missing parts he couldn't copy and cheat me out of.

The server ip (65.75.160.52) traces to Managed.com. I'm going to email their abuse email now with this thread to see how they handle this in addition to letting this person know that I'm doing the same. All graphics (when applicable) and concepts were made by myself and I am a little more than angry right now.

Any other advise on what I should do? I've got screenshots, pings, tracerts, whois and various other data on this person/site but I wanted to see if I'm missing anything.

    Regards,
    Jason

    [sarcasm]Yeah, the similarity is astounding.[/sarcasm]

Well, are there any bases I'm not covering in protecting myself here?

I don't think so. By contacting their upstream provider, and them, you are doing all you can do for now. Who knows...maybe they employed a web developer who is more experieced at changing layouts than designing them.

Give one or both of them some time to respond and act, and you might find the similarity goes away.

Well, I've emailed the registrant, and multiple managed.com abuse/info addresses on this issue. In further examination, this user still has my business name in coding throughout the site. My demodemo movies are not there because they are branded or the user wasn't able to download them. Many forms and links don't work because the user doesn't have Autopilot installed among other things.

At this point, I'll wait to hear back from Charles or Managed.com or my attorney will take it from there.

Even they're latest news are your latest news. This is soooo funny. I'm sure for you it's got to be traggic rather than funny, but you have to admit that the fact that's a perfect ripping example adds bit of humor to the situation.

Good luck solving the issue! With such evident proof I shouldn't be too hard to get their site closed.

Jason, I can only imagine how you must have felt when you saw this. On a positive note, I don't think that this site will be up for long.

    Good luck w/ this.

Well, the site is down, apparently by the user, though, I'm waiting for more information from managed.com who is researching it now.

I discovered the user is a poster here. I won't go into details but you can find him if you do a little searching.

It looks like he's running his own custom nameservers (dns-oc3.com) as that domain is also registered to him. I'm unable to even ping/tracert the site since about 2 hours ago today so it looks as though he's running dynamic dns.

    Amazing...

I'm only waiting now for him to come and post in his defense saying how it was a designer that he hired that ripped the design. It seems everyone accused of ripping tries to pull that one off.

    hmm....

we all do the same type of copy-catting, although in our own ways. however, doing the copy/paste job is sheer waste of one's time and money. it takes some terrible lessons to be learnt before we STOP doing that.

Okay, the user has his site back up and running with my full rip. It appears that he did something that took it offline today since he is still trying to learn how to set the whole thing up.

Funnier still, he's posted as recently as a few hours ago on WHT asking for assistance with setting up his server.

I'm naming names now and would like a response back from webonixh:

    profile: http://www.webhostingtalk.com/member...o&userid=60216

I emailed you very early this morning after first starting this thread in hopes you'd promptly remove your current site and seek something original. I'm currently pursuing this with Managed.com and have copied my attorney on an email I'm sending you in the next five minutes. I'd like to see MY site rip completely removed from your server tonight.

I'm currently on AIM if you feel the need to chat. I will post a link to this thread in the other posts you've started in hopes you'll make an attempt at contacting me immediately.

Thanks for that. It's helpful to this issue.

Furthermore, it's a play on words considering I live in Charlotte and a large portion of my client base is local. The Charlottesweb domain name has been registered to Knight-Ridder for right around a decade and they are keeping it locked down.

    Anyway...

    blue,

have you sweared to your God or whatever you worship, that whatever i say, you will oppose that????

now, what the heck is wrong with my clear statement and what the heck am i supposed to do each time you post negative or opposing remarks to anything i post. perhaps, i am emotionally disturbed, or perhaps you i am so young on this forum, with just less than 200 posts, you are so old, with 2000 plus posts, so, perhaps i am the one who is supposed to be a STUPID person and you are supposed to be WISE enough each time i try to air anything of my OWN opinion.

God... where is the patience and accomodating people????

    truly yours

As an FYI...someone dug up this thread from nearly 2 months ago for some reason today.

So yes, this guy is now using a different template, though several graphics and probably half of his text are still mine. I've contacted the planet and servermatrix multiple times without so much as a response, so they're pretty much worthless too. Until such time as I decide to get my lawyer involved, that's where things currently stand.

Well, I'm the last person to badmouth another host, but for your sake, I'd consider how important your business is to you and if you trust someone who is that dishonest in their business practices being responsible for it being up. My 2 cents.
