Is a band name (music, that is) a trademark, or is it safe to register it for a fan site ?
I am a fan of Marilyn Manson. I know marilynmanson.com exists already, but would it be safe for me if I'd want to register let's say marilynmanson.fm for a fansite ?
Or could I get a court case if I'd register the band name with any extention ? (even though the official site never showed interest before in any extention but a gTLD)
I used the example of Marilyn Manson, but my question goes for all bands. For example: would it be legal to register beatles.tv, rollingstones.nu, nirvana.cc, elvis.is, ... I guess you get the question by now
I wouldn't risk it at all. It won't be the artist that is coming after you, it will be Sony or Warner Bros - now imagine what's going to happen when they send their lawyers. Think of the way they handle Kazaa and edonkey...
Although as an example... KISS missed kiss.com, they have kissonline.com, but kiss.com was used years ago, so at that time, first come first go may have been OK, but these days - no way.
Maybe you guys are right... After all, adding a word to it and there's no claim at all (Warner can complain about marilynmanson.fm but not about marilynmansonfans.net or something like that)
Still, I wonder what the average band would have against their name being used with an extention they never cared about. Would Warner or the artist himself bother to make the efford to complain about the registration of for example marilynmanson.mn, while the average Mongolian inhabitant probably doesn't know him at all ?
