Groklaw says SCO has a point?


Interesting article on /. about SCO. Apparently, Groklaw has done some extensive research and traced the code that SCO has been whining about etc etc.. read up!

LOL It's possible.. I read the article and there is a couple of links to Caldera.. And guess what..

Basicly it says that SCO is full of it.. If any such code is being used within the Linux community it's becasue they put it there. Knowingly or un knowingly they distributed it under the GPL.

I only read about 2/3 of it but I think this sums it up..

"I think you will see from this article alone that if SCO is planning to sue anyone over the ABI files, unless there are facts we haven't unearthed, they seem to be leaning on a rickety bamboo reed."

It doesn't mean that SCO has a point... it means that Caldera intentionally submitted code for Linux which means they licensed it for use in Linux themselves if it's true.

Groklaw have traced quite a lot of code segments that Caldera intentionally released to Linux (with interviews from some of the coders who did it).

Basicly what it seems to boils down to is that alot of code was released before SCO bought Caldera, Unix. or the exclusive rights (If they indeed have them) so being as this code was already released under GPL prior to their acquisition they're screwed. What's done is done.

You can't give away something in the public domian then turn around and say, oh we've changed our minds now you've got to pay us to use it.

This whole deal is out of a temper tantrum. IBM pulled out of their little deal thus taking away the engine for their gravy train so now they've got to do something to look good. They've bitten off more than they can chew now they are choking. Eventually they'll turn blue and fade away.

It's just funny how in this case the Big Blue has them by the short hairs. It's abvious all who turn blue arent going away anytime soon! lol
