Just because they own the website and the software doesn't mean you aren't allowed to use it in a domain name.

may be you can use any name to your proudcts
but that dosnt mean you proudct name is trademark
you must register your name as trademark

i want to answer you about > when domain using was illegal ?
when you use site in hacks or styles or other proudcts like vbulletin.org-vbulletintemplates.com without licences from jelsoft

and also you can see vbulletin.net it sold without any problem in trademark
