TelVPS - rules do not exist

Probably it is very strange, when the supplier writes about another supplier, but I have screenshots of all the evidence. I also have the right to do so.

This history started, that i was needed 2 windows vps servers for monitoring. Price: as cheap as possible. I found TelVPS.com

I bought 2 windows VPS servers: USA and Germany. Their VPS servers are INSTANT ACTIVATION, but both VPS'es did not start I wrote a ticket: German server manually started within 7-8 hours, the USA - over 20. 7 - 8 hours - good for budget provider, 20 - 24 acceptable for new customer.

Servers have been stable untill 2011.12.1 - i forgot to pay my bills. Thei suspended my VPS. That's ok. At 6th day i remember, that i need to pay. I found invoice, paid, and wrote a ticket to unsuspend my server. What i got:

"Hello,

The VPS was terminated automatically by the system. Would you like new VPSes?

Well, maybe my false, that i forgot to pay.. but i found their rules: https://telvps.com/tos.php

Account Suspension and Termination

Invoices for due account balance will be generated 10 days in advance of the invoice due date. VPS accounts may be suspended on the 2nd day after payment is overdue, unless prior arrangement for payment has been made; servers will be automatically restored to service once payment is received. VPS accounts may be terminated if invoices remain unpaid after 7 days. Should TelVPS deem that a customer has abused our network and compromised our position with our network providers, a fee of $200 for network abuse will be charged.

DUE - 01.12.2011, PAID 06.12.2011 ..

Those in servers was not anything important, only last month statistics. It's more a matter of principle to get money back because they fail to comply with their written rules. I paid and extend excisting services with excinsting data

Sithuation now:

Services:
Before: http://img171.imageshack.us/img171/156/paypal4.jpg
Now: http://imageshack.us/photo/my-images/585/paypal7.jpg/

Hello,

The new VPS information has been sent. After invoice non-payment, we reserve the right to terminate the VPS immediately. I think 7 days is generous enough.

Thanks,
-Mark

Okay, so while you were going about your merry business, forgetting to pay your bills (doesn't sound good coming from a business owner and corp member, btw) you happened to remember that they give you 7 days to pay your bill before termination?

At the end of the day, there was an outstanding bill and you didn't pay it so all I was saying, lesson learned - pay your bills, is quite true

Well, no. I asked to unsuspend my VPS servers. When they said, that they do not have my VPS data, i found their rules. That's simple.
This is from my experience - many people forget to pay and every day i am working with them.

I'm curious. Did you read the whole ToS? Because it also says "TelVPS may cancel or suspend your access to TelVPS services at any time and for any reason without notice." I'm sure you didn't read that one.

Pot and kettle really.

I remember an issue with you spamming people from WHT, including me, looking for business.

Well, this is not good, yes? Any time without reason?

I personally have never spam any users. We are talking about telVPS, not about my and our company.

You are very insensitive

No, I'm quite sensitive. You're calling a company out for, apparently, going against their own rules.

You have a history of similar behaviour. Additionally, as abdullahrafiq has pointed out, it's stated in their TOS that they can terminate your service at any time with no notice and for any reason.

I can't create another user in WHT, what's the main problem.

If i bought two VPS servers and i am unhappy, what i need to do?
I think probably forget, because I can't write here...

Ok, no problem. discuss without me

What you need to do is read the ToS of a company you buy from, before buying from them and if you don't read it, don't blame them for it. You want me to get a service from your company and chargeback and then say "Oh didn't know I can't chargeback?" and then write a bad review because you will cancel my service?

And you also need to stop spamming..I got one of those too.

Why not? It's a standard clause used by many hosts. Even YOU have it...

You got an invoice 10 days before due date, a reminder sometime after that, and probably at least 2 reminders when you were past due. OK, so you just "forgot" (anyone can do that) but to try to bad-mouth a host for doing what you would probably do yourself is just, well, unprofessional (to stay polite).
