domain name copyright


hey all,

I have a quick question my name is Joe Moore and I would like to use joemoore.co.uk but it is taken by someone without that name since i was born with my name that person has breached my copyright for my name? so i should be allowed to have the domain name?

Unless your name is registered trademark, you cannot claim the rights to that domain.

You will have to use another domain or try contacting the owner of joemoore.co.uk and buy it from them.

Thousands of people share a same name but the domain is one so everyone can't own the domain. Its like whoever got lucky in registering it first. I'm not too expert in legal things but I guess you could take the matter into court if they try to make any profit while using your goodwill and identity. Usually that happens when people register celebrity names and then try to sell stuff like their autographs, t-shirts etc.

joemoore.co.uk appears to be parked with the hosting company - so maybe Mr Raphael Scullion got bored with it?

You could always ask him if he is willing to sell it. He has his full postal address listed in the Whois.

However, if you are operating a business under your own real name then the .co.uk is obviously the preferred option

If you are indeed using it for business purposes given the .co.uk is taken, what about the trading name of that business
Equally, could include both, example :
joemoore-website.co.uk

.me.uk is very rarely used, not a very good idea.

I am no legal expert neither, but I do believe that a name is treated in the same way as a trademarked name: you can take it to a court but will need to prove that the original owner registered with mala fide intentions such as using it for a competing website or using it with the intention to harm you one way or another. Unless the owner of your name's domain did register with mala fide intentions, I'm afraid you indeed either have to buy it from the owner (if willing to sell) or register it with another extention.

Most generic names like that cannot be copyrighted in any event.

I honestly doubt Nominet will take your side, at the end of the day first come first served unless it is a proper trademark.

Nominet wont take your side. There is no provision for 'default ownership' of any domain with them unless it is a .ltd.uk domain name.
