    Thumbs down My bad experience with Jennie (Just Another Sunset) eBay shop

    I just want to share some experience how some eBay sellers ignore buys from outside USA.

    I paid $8.79 for a greeting card from eBay, finally I got a cheap card worth only $0.10 , I am sure it is a home made card, designed from Photoshop, colour faded. The worst thing is that the card was a different one which I ordered from eBay.

    In the case, most of us would request refund or an exchange, right? My nightmare begins:

    Well, the card is not what I wanted, why should I pay more? I would post it back and get refund. Or I will leave negative feedback on eBay.

    I posted the card to you on 28th March 2011 by air mail. It costs me
    1.82, I asked for tracking number and it would cost me 6, the refund
    will be 6 as well, so there is no point to have a tracking number.
    Receipt is fine I send to Paypal the paper receipt. Your address is just
    a P.O. box, so please check your P.O. Box. I did send you the post card
    back. Please reply with manner, be polite to your customer!!!!!

    Well the office number (925)487-4361 is just a voice machine, there is no customer service number!
    The returning address is just a P.O. box which does not accept mail with tracking number!

    However, we must receive the feedback change to a positive rating first.

    Paypal request a tracking number and give me full refund, however, to have the tracking number, it would cost me 7 and the refund is even less than that, here in the U.K. everything is expensive.

    I think she has already received the returned card after 16 days and just did not want to refund me. If I change ebay feedback to green positive she might not given me refund because simply I am not trusting her if she did all these to me.

    Please advise what should I do in the case?

    How did you add funds to your PayPal account? If by Credit Card, then call your card issuer and file a chargeback.

    Frankly, I would have done exactly that as soon as it became clear that they were not going to honour their side of the agreement. It is then up to them to collect the item from you at their expense.

    You've backed yourself into a corner where you've paid out more money to send them the incorrect item, and you don't have proof of postage/tracking information.

    Thank you Joseph. The problem is that the seller sells more items and got discount from some couriers, it costs me more to return the incorrect item with a tracking number. In the case, the seller got my money got my returned item and laughed at me, I can do nothing about it.

    My Paypal got funds from my bank account, it was not from a credit card. Paypal gave me $4 to keep me happy but the problem is that the seller still got my money. I do not care about the a few dollars, what I am angry is about the attitude of the seller. She treats customers as stupid people.

    Don't do that. All you're doing then is starting a fight with Paypal, and Paypal can very likely convince your card issuer that the charge was authorized based off your activity on eBay.

    When you file a credit card chargeback with Paypal, you're screwing the merchant sure... but you're also screwing yourself because now you've taken money from Paypal. They will come after it.

    Also for future reference, you can't use the phrase "please [do action X] or I will have to leave negative feedback." Like she said, it's feedback extortion and you gave her an out to be a jerk about the refund.

    I know but in what case I should leave a negative feedback? I have already left the negative feedback on eBay, the seller Jennie asked me to change it to GREEN positive before give me refund. It meant if I do not change the feed back to green, she will never give me refund even she got my returned card. This turns to a funny case. Not sure I should turn it green or keep it red. What would you do?

    If you change it to green it doesn't guarantee she will refund your money. If I were you, just leave it red. Can you file a complain with ebay too?!

    I decided to leave it red. eBay directed me to Paypal for refund, Paypal agreed the refund only if I post the incorrect item back with a "tracking number" which is more expensive than the refund. It is something like that I pay 7 for a tracking number and get refund of 6.

    Buyer fails to tell you he has harassed me by emailing me up to 20 times a day, when I blocked his emails he changed his email address. He has CALLED me about a dozen times from the UK.
    He has swore at me, insulted my nationality, and sent nasty message, etc.
    He told me he wanted to KEEP the card and have me send another and if i didnt he would leave me negative feedback on ebay.
    and still emails me asking me to send him a card, even though he claims it is shody workmanship.
    He also fails to state he received a refund from paypal and STILL wants money from me, in addition to his alleged return shipping costs. The item was not returned, I have emails from him where he states he would not send it back.
    This person is spending HOURS of him time, even threatening to show up at my office daily until we give him and give him more money, even though he is in a different country.
    He is spending a lot of time to harass me. If we were in the same country I would have to file a police report, he is clearly unstable and we regret any contact with him. Who goes to these extremes over less than $10? This is not a stable person.
    We will not respond to him further.

    OP, you lost my sympathy the moment you started threatening. Not saying that the situation was right on either side, I just don't agree with how you handled it. Why didn't you use eBays messaging system?

    As a quick comment, I hope you sent the card back with tracking information. Without tracking, you're likely to lose the claim if they claim they never received it back. :/

    The seller is lying, Paypal did not refund me, Paypal paid me $4 as an insurance to keep me happy. But the seller still got my money $8.79, what she needs to do is to go to the item in Paypal and click refund for the $8.79. The seller obviously trying to keep the money.

    I rang the seller's customer telephone number twice within 2 days not 20 times a day(as the seller described) to ask her if she received my returned item, but it was a voicemail, she never picked up the phone, was that harassment? If she picks up and say yes she received it and refund just like other sellers do, that would be a normal case and I would leave a positive feedback on eBay.

    In the case, I lost $8.79 through eBay plus returning item 1.82 (Air Mail) plus a padded envelop (I paid it, forgot price, might be 0.50). Paypal lost $4, the seller made $8.79 and got card back.

    I did not threat anyone, the seller did threat me if I did not turn eBay feedback to red she would not refund me, it is my choice, if I ask for a refund which is a threat, customers would be victims, sellers turn to thieves.

    I feel I got robbed, and I can not ask a refund because it is a threat.

    If the tracking number costs 7, and the refund is just 6, would you send the card back with a tracking number?

    If I post a blank paper to the seller with a tracking number, Paypal would refund me? There must be a black hole.

    I am a good person, I posted the original item back to the seller with a cheaper Airmail 1.82 (Well, it is not cheap as it is not my fault, 1.82 could be a burger with a can of coke in the U.K.), but I was wrong, I should pay the tracking number 7.00. I don't care about the money, I just did not want the seller get my money.

    I am helping other victims, a lot of other victims do not fight for the small amount, so the seller (Justanothersunset) keeps making money and use more victims.

    No, only 4-5 emails within 20 days to check if she received my returned item.

    No, I didn't. She's lying, I said the card quality was not good, she thought this was a insult and I insulted her country, this is nothing related with "countries", it was the card problem! She used "bugger off" etc. to me. She got 3 negative feedbacks from different members within last 3 weeks, she replied all negative feedbacks with rude messages and lying. Check her negative feedback below:

    She's lying again, I already posted the card back, I have payper receipt from a UK local post office. I did not receive refund from Paypal. Paypal did give me $4 to make me happy as I have been with paypal for so long, it is nothing related with the refund from the seller!

    It is a small amount, ture, just because of this, most buyers do nothing about it. If the seller sells cheap cards with a tracking number, let's say she makes $1 each item, she would be rich.

    To be honest, this is a Web Hosting discussion forum - not a forum to mediate disputes between eBay members based on no factual evidence whatsoever from either party.

    This is what needs to happen here...

    1. The OP needs to post full screenshots of any emails exchanged.

    2. The seller needs to post PayPal screenshots showing the (claimed) refund.

    Without any further evidence this thread needs to be closed and disregarded, since neither party can prove anything.

    Evidence is this: http://109.75.173.28/~plus1hos/usa_item.jpg , it is the receipt that I posted the item back to USA on 28th March 2011, even it is lost, the seller could not accuse me that I kept the card and wanted another. Obviously the seller accused every buyer who requested a refund. All I need is the full refund and the apologies.

    The seller did not refund me, Paypal gave me $4 as insurance because the seller did not want to refund me, that's not the refund which deducted from the seller.

    The only way to get refund is to pay more to get a tracking number, the seller obviously knows nobody outside USA would do so, Paypal can do nothing because Paypal request tracking numbers and it is not possible for the small amount item.

    The seller stole my money and kept the few dollars and continue to cheat other UK or Canadian buyers.

    Geez I'd just ignore it & drop it is it worth it for about 5 or have you nothing better to do than argue over something so trivial.

    All this disputing, the time & energy for a fiver

    I *think* you have to use your credit card direct to the supplier to be protected by s.75 of the Consumer Credit Act.
