Is this a cPanel server?
If so just put the error documents and the .htaccess in the skeleton cPanel directory. That is how Hostgator does it with their new accounts and whatnot.Jacob Wall - GetCloak.com

yes it is cpanel, I tried adding a 500.shtml on /root/cpanel3-skel/public_html, but it doesnt change anything. I'm still getting:
Internal Server Error
The server encountered an internal error or misconfiguration and was unable to complete your request.
Please contact the server administrator, [email protected] and inform them of the time the error occurred, and anything you might have done that may have caused the error.
More information about this error may be available in the server error log.
Additionally, a 404 Not Found error was encountered while trying to use an ErrorDocument to handle the request.
when for example the index.php file is chmod to 777 (the server is on fastcgi with suphp has handler)

Did you copy the new error pages to the account you're testing on? cpanel-skel only affects new accounts
