should I contact my credit card for chargeback now? or I should wait for paypal?

long story short, on Jun 23 I have purchased a template from Andrew.S. However after payment is made he refused to send me anything, no template, no pm, no response, even though stats shows that he is online for at least twice. He just simply ignore me

So this morning I have decided to file a paypal claim and I got an immediately response from Andrew, via paypal claim (he is not disappeared ) :
    • Tracking number: intanglible item
    • Shipping company: virtual goods.
As you can see he is trying to play the paypal game. Furtunately when I sent fund to Andrew my paypal account balance = $0, which means I can contact my credit card to file a chargeback. However I'm not sure if I should just wait until paypal resolved the problem, or should I contact my cc company immediately.

    Please help.

Your bank will most likely refuse the chargeback unless you have exhausted every other possible way of getting your money back, so wait for PayPal to handle the dispute. Chargebacks can be done several months after the payment is made, so there is no rush.

I don't think you should submit a chargeback just yet. Seems your guy has numerous contact details, keep trying a little longer. (If you have a longer period of time within which you can chargeback). Paypal might not like chargebacks very much either, so I would try to avoid it if you can for as long as possible.

You can put the claim in dispute with your credit card company if that's what you used. If its an American Express card, you'll get the money back as i'm sure he won't want to deal with their lawyers. I've used AMEX for purchase disputes regarding failed to oblige contracts and they are relentless.

Be careful of the chargeback, as PayPal could come after you for the funds.

First see how the dispute plays out.
