Do I need an Offshore or Bulletproof host?

Wow. I've been reading through the forums here and there is a wealth of great information. Fantastic board.

I am starting a website that will be adult content, but not pornography. Absolutely nothing illegal. NO child porn or anything of that nature. NO spam or bulk email. However, the site will likely ruffle some feathers and probably attract legal threats (i.e. remove my name/photo or I'll sue). I'm thinking this might happen because a similar site has received these types of threats.

I need a host, but don't want a host that will freak out if they receive a threat. I am also wondering that if I were to have an offshore host, would I be protected in the event that someone did actually decide to sue?

How much protection (and what kind of protection) does an offshore host really offer?

Get a webhost in China. That is where loads of the spammers come from and the chinese really do not give a hoot about the internet.

It doesn't matter where the server is if you are operating out of the US you can still be sued.
If your content is that controversial you may need to look into a dedicated server as I don't think a quality host would allow a site on a shared server if it had potential to have the IP blocked.

What do you mean by "operating"?

The domain is registered with a US address.

That is what I mean. If you are in control of the site and you are running it from the US you are responsible for the contact and are liable.
If you are not recieving any revenue from the site you may have few problems if you remove questionable content when requested but I'm not sure to what extent the laws reach.
What I do know is that most hosts don't like to bring that kind of negative attention to their servers.

Yeah, that's what I was thinking. I don't want a host who will drop me like a hot potato if they receive a threat.

Pfft, there are tons of offshore illegal sites, and I do'nt mean warez. Discussion of CC Fraud, ID fraud, Fake IDs, etc is rampant, but the US Gov't can't do anything to nab these people because it's hosted in a country which does not cooperate with US officials.

So, are you saying that there isn't much that can be done legally if your server is offshore?

Again, I will NOT be doing anything illegal, but that doesn't mean that some disgruntled soul can't sue me.

just so your aware posting a pictue of someone else without there permission is in many instances illegal, there are a number of possible legalities for example are you displaying a picture taken by yourself or someone else? if someone else they own the copyright. are the pictures in a degrading or comprimising situation? if so then you liable for that. finally if you took the pictures and they are of just fully clothed people on the streets then who is going to visit the site? no liability but also not much of a purpose.

there is still liability when using just fully clothed people on the street. Have'nt you ever noticed news reports often show people walking down the street from the waist down or away from the camera . . .
