Depending upon your state, you would likely need at least a tax number (for taxes). I would advise against being a sole proprietorship, as if there is any legal problems, the courts could seize your personal assets in addition to company assets.

You need to talk to your secretary of state's office or whoever is in charge of this kind of thing - go to the state you live in's website, and search for starting a business (alternatively, Google search for "starting a business <state>"). Some states don't require anything at all, some states require a DBA registered at the county level, and some (like California) will make you question whether or not it's a good idea to even start a business.
As stated above (the first really correct answer in this thread, because IMHO any answer given without knowing the state your in runs the risk of being wrong), a sole proprietorship mightn't be the best idea to begin with, so you might want to consider formally organizing a company regardless of whether it's required.I used to run the oldest commercial Mumble host.

It really depends on the state your in. What you should do is go get advice from a local CPA (Accountant). They could give you better knowledge on what legal stuff you would need to comply with as far as paying taxes and what not. Personally I wouldn't think you would need to do anything at first, at least not until your company starts growing pretty heavily, and your making actual profit.
I talked with my dad (He is a CPA in NC) about this when I was in the process of starting my hosting company, and he told me not to really worry with it at first because of the little amount of money that was going to be made. However he did say when the business started growing, I would need to start paying taxes on my income and so forth. But this might vary from state to state, so I would recommend you talk with a local CPA about it.Last edited by rpoarch; 07-03-2010 at 03:10 PM.
