Hi

I have been a member for this forum for almost a year. We met http://paytondesigns.com/ payton and he told us he would build us a original website for our hosting side of the company.

We thought it would be a relief of having someone else from a popular forum do our site but....

He is selling duplicating clients template...

I have just found this out so sorry for the delay in my responses.....

I would like to do something about him and our design

Can someone offer suggestions

How do you know that hammerhost hasnt stolen your domain. Ive purchased from Payton Designers over time and had no problems.

Im sure if you contact them you will get an answer.

How do you know that hammerhost hasnt stolen your domain. Ive purchased from Payton Designers over time and had no problems.

I have contacted them today and when these post about us stealing a template is false.

Payton need to respond, they are online thats they job

Payton do get quite busy and there not online at all hours of the day. Im pretty sure they will respond.

Have you given them a link to this thread so that they can at least reply to the allegations made?

This is quite disturbing... Didnt you read the topic where he failed to show proof that he purchased the design? I'm not sure what you are talking about but its quite rude to accuse me of false accusations without even contacting me to discuss it. You sent me 3 Private Messages, all within 10 minutes and decide to post on the forums because I didn't reply? I'm not on these forums 24/7...

You are crazy, I sold you a template and it has since been stolen obviously. Why dont you send a DMCA?

This is untrue, Payton new this site was here in december and he did not say or contact us about the design being stolen

There's plenty of software that can be used to rip a site. Payton has done business with hundreds if not thousands of clients, and the vast majority of them are satisfied. I really doubt payton would ruin his company's reputation for a quick hundred bucks or so by selling you a ripped template. Maybe you should've talked to payton first instead of immediately jumping on WHT and using it to trash Payton's hard earned reputation.

Unfortunately templates get stolen all the time. Check out the Web Hosting board; there's usually 1-2 new threads per week about stolen templates (also called "rips")

I'd suggest that you go through the proper channels - e.g. send a DMCA - instead of accussing someone else without any evidence.

Stealing templates is an all too common problem in the hosting industry. This is often called Design Ripping (Do a Search on the forums and you will see what I mean). There are several tools that can be downloaded to allow a person to make a copy of your website, this is the way most people steal templates. I would not account Payton Designs of fraud. I have used Payton Designs myself and have had nothing but fast and professional services. In fact I am going to post a few reviews when I get a few moments.

Since Payton reports that he sold you the template to you, I must side with you as the legit site. I would send a DMCA. You can also start a thread called "HammerHosting RIPPED my Design" that would be a more approiate title :D.

It is funny reading HammerHosting's TOS "Any ripping of any of HammerHosting websites is strictly prohibited on our servers"

Just out of curiosity how long have you been in the hosting business?

Everyone knows about WHOIS. The only way to hide the details is via Whois Protection.

You have been on here less than 1 year and people may find it hard to believe that payton allegedly conned you out of a design.

And then to top it off, you blast away at anyone who challenges you, after you created a thread in a public forum asking for opinions.

It's called a rip. They use a program to grab your entire site from your server, and then use it as their own.

How hard is that to understand? Your design was STOLEN, not RESOLD.

I've had clients pay half up front and never return to pay the additional half after I had invested all my time to complete the design.

The only way we deal since then is full payment up front.

I run a very reputable company and we are very well-known on these forums. If you are unsatisfied, you will be refunded although it has never happened in the past where a client went un-happy with their design.

1. Contact Payton with your concern (and give him more than 1/2 hour to reply on a weekend!!)
2. Contact hammerhosting and ask where they got their design.
3. Once you figure out who the crook is, then take appropriate legal action.

Instead, you chose to jump the gun and post libelous statements against the designer.

Can you see/understand the difference?

I'm not sure how we got to this point, but I cannot fathom how you have leapt to the conclusion that Payton has sold your design on or whatever.

More to the point, you seem to have an issue with patience, please take the time to resolve this directly with Payton rather than posting random allegations here.

I have used Payton in the past, and I know who I have more faith in between you two.

Payton does not know how to categorize his emails as low or critical.

When he was doing my site he responded like i did not pay him up front.

I really dont know if he is honest or not because of his customer service skills

caredding, there are many things you should learn about web designs:

1. Stealing designs is very common, half of the internet is using the designs stolen from the other half of the internet.

2. There is nothing to prevent it. Payton cannot do anything, you cannot do anything to prevent it.

3. If you encounter a website that is using your design, you can stop them using it.

4. To stop a website, you should contact them first and explain the situation that the design they are using is actually yours.

5. In more than half of these cases, the other website with your design is also a victim of design theft. They probably contacted another designer to create a unique design for them, but the designer stole your design and sold it to them, without their knowledge.

6. If that's the case, the website owners will take the design down from their website.

7. If they refuse to take down the design in 24 hours, you should contact their host, and ask for them to close that website. This is called a DMCA notice and it can take upto 48 hours to wait for a result.

8. Accusing people without proper research is considered very immature and makes someone look incompetent for potential hosting customers.

If you purchased the design with full ownership rights (which you said you have), then there is legally nothing Payton can do, because the design is not theirs anymore, but yours.

You should follow my recommendations for a solution, contact hammerhosting and ask for clarification.
