I designed this website a while back for a client Here is the original design (http://asantedev.com/clients/Nerios%20Communications/Homepage/).

The client then hired Payton Designs (http://www.paytondesigns.com), to finish off and code the design (to save money).

It looks to me as if Payton Designs just added a few price tags and a banner (I designed the clouds at the top for the client as a last minute revision).

If you look at the bottom of the site he has replaced the "Designed by Asante Web Development" with "Designed by Payton Designs"

Is this acceptable? I am not extremely bothered with it but it does seem unfair that he is claiming my hard work as his own.

Also, out of curiosity, how does he manage to get so many clients from WHT?

I agree with you. After looking through the links you provided. Payton is guilty I am sure of it. Also extremely unfair he is claiming that was his work. Mind as well change a few colors and just claim he did it.

But Payton's portfolio page on nerios says: "Designed: Website Reconstruction." Other designs say "Designed: Entire Website." Perhaps nerios themselves added the designed by at the bottom. Have you asked them?

It does indeed look like he was hired to reconstruct your original design, that being said the reconstructed version will look a bit similar to the original version. However, it even looks like the final reconstructed version is a little overly inspired from the cloud hosting design in your portfolio. After skimming through Payton's portfolio it looks like this isn't the only design that looks noticeably inspired by another design. For example, check out VPSPort in his portfolio and compare it to http://gigenet.com. The plan comparison area even uses the same exact button's as the gigenet design. Your case does not look a rip, but it does look like he did inspire off your cloud design on the reconstructed version. Maybe Payton can come in here and shed some light on this and give us his side of the story.

Hi Sam,

Please be truthful in your posts, I did not go to PaytonDesigns to save money, I want there to have my design finished due to you failing to do so.

I originally contracted AsanteDev to design the homepage for Nerios Communications. To begin with, Sam was very promising. I quickly paid the deposit up front and was advised I was going to see progress within 2 days, and if I was happy with the mock-up, a fully functional coded design within 4 days.

A week passed and I had heared nothing back, despite numerous emails which were left unanswered. When Sam would sign onto MSN, he would conveniently set himself as 'Away' when I would question him about the whereabouts of my design.

Sam finally got back to me to let me know that he would start working on my design immediately, and that he had been delayed due to the screen on his Mac cracking and having to source an external monitor to continue working, along with various other 'personal issues'.

I gave Sam the benefit of the doubt. A few more days passed and I still did not have a site completed, nor a mock-up. Well into the second week and hearing nothing from Sam, I sent him an email requesting a refund.

A few minutes after sending my email, Sam signed onto MSN and apologized and promised to have a design to me within the next few hours. True to his word, I had a design - Don't get me wrong, the design was clean but lacked most of the features the we had agreed upon when I contracted him for the work.

I asked Sam if he could make a few revisions, he assured me it wasn't a problem. Again, more days passed and he was busy 'making revisions' on other websites and hadn't had time for mine. Sam also 'forgot' that the design was supposed to be coded and said his coder was too busy to do it now.

He gave me a partial refund for the coding costs and offered me $25.00 off of my next design. He sent me the files, and told me that he was sorry for what had happened over the course of the two weeks and advised me that this was not the norm.

After receiving the files I posted a Design Request (http://www.webhostingtalk.com/showthread.php?t=860085). Payton took all the changes I required into consideration during the 'reconstruction', and I had to pay double what I paid AsanteDev in full, and up front. The Nerios Communications site ended up costing me 3 times as much as it was supposed to.

So to clear things up: The designed wasn't finished by Payton to save money, it was finished by Payton to get things done.

Sam had asked me not to post a review of this 'saga', but I felt it was unjust for him to passively trash a designer. I do believe Sam is skilled in what he does, but lacks the business ethics to be truly successful in his field and hope that he can someday improve on this.

Just as a side-note, I recently (this morning!) purchased a template AsanteDev had for sale earlier today. If I had seen this post earlier, It would've made be think twice before doing so.

In regards to the 'Designed By: Payton Designs' footer, I put that in. I felt it was only fair as he made all the changes I requested him to do and within the timeframe he advised me of.

Ah thanks! That is fine by me. I was just a bit concerned that another designer was trying to claim my hard work as his own.
