I would like to create a fork of CRE Loaded, I've been using for several years and have removed much of the bloated code, reduced the sql queries about 80%, and have created many changes.

Of course it would be free.

What would be the legal aspects?

Some of the changes I've made are full-text search, product comparison, product grouping, better image handling, improved templating,product displaying,,,

That's a good question since CRE is just OScommerce with some community and custom addons.

I asked about their licensing for their paid versions but could not get an answer as I would assume it would also be GNU as CRE free edition and osCommerce

I read on their forum once that it would be possible to do it if one removed all the references to CRELoaded in the code. But you really should talk to a lawyer specializing in this matter instead of asking on this forum.

Any comments in the code to CRE must remain. You do not, however have to display footer information from CRE. Remove the phone home code to their analytics account on google.
