One of my web site was cancelled becuase of DoS attack. (DoS attack my web site--the owner told me).

I don't know it is true or not. Or maybe I have use to much bandwidth(about 30GB/month) so they want to cancelled my account. (I signup with them on March with high bandwidth and low price, but now they raise the price and lower the bandwidth.)



I got the email(11/04) :
This morning your site on server15 was the target of a spoofed or Multi-IP ICMP attack. The data center has actually blocked external access to our server because it took down two switches.

For this reason, we're going to have to cancel your hosting account with us as soon as the server is accessible again. I did put a backup of the sites files online for you to get, ....

Ok, I have moved to other hosting company, without complaint, just ask for refund for this month.

But the owner said :"Unfortunately because your site was attacked we cannot offer you a refund. The downtime and loss of customers we had because of your problem does not let us do this."


There is no problem for me to move to other hosting company, I just want to know is that reasonable to cancel my account and no refund?

Well, IF your site was indeed the cause of trouble, no refund, yes.

Generally, suspended sites don't get refund as the contract was violated by customer.

Check their terms of use. Unless it specifically states something like: DoS attacks on your site will result in your account being cancelled without refund...

...then you have every right to consider the position from a legal aspect.

In truth, a lot of companies [of any kind] feel empowered to dictate terms. They can easily forget that what they own is a responsibility - a legal held responsibility at that.

Some places think they can mis-treat customers, because the majority of customers won't act on it.

But if you make the effort to reply and ask for a refund in a mature manner, you should be able to get there. If not, calmly inform the company that you will be seeking legal action unless they offer you an appropriate refund within 24 hours.
