View Full Version : PayPal: Buyer was Scammed $300 - How to Proceed?

A little less than a month ago, I purchased a script license from someone second hand for $300. Just yesterday, I logged into the script customers' area and saw that my license had been suspended. I then contacted the developers and they said that the original owner had issued a charge back with this credit card company and that they therefore had to suspend the license.

I sent those $300 as "Goods", not as "Service/Other". Also, my account is 4 years old premier and verified while the seller's is less than 30 days old, although it is verified.

I am wondering how I would arrange the dispute so that I have a good chance of winning.

Any help would be greatly appreciated.

The best way to do it is to be honest and contact paypal to explain the situation.

In other words, you should submit your own buyer dispute right away, and then explain the exact situation in the notes for the dispute.

(BTW - the seller is most likely going to claim this was a non-tangible item that they sold, and you will most likely lose the dispute. I don't think there is anything you can do except to be honest about the whole issue.

Sending them information about the chargeback is not going to help, since it's 3rd party and unverifiable information so PayPal won't use it when making their decision.

As far as paypal is concerned, you purchased an "intangible item" (software) that is not eligable for buyer protection. However, you might get lucky and if you explain the situation.. then perhaps the person evaluating your case will have mercy on you.

Perhaps you can ask the software author to contact paypal on your behalf and confirm that the license you purchased was suspended for fraud or something?

Seriously - good luck with that. PayPal is the absolute devil. I've got many, many years of seniority on my account over yours and they weren't budging one millimeter to help me out when a scammer ripped me off for a cell phone by charging back on his credit card months after the transaction was already complete.

I avoid PayPal every chance I get. It's not safer, it's much less safe than using your own personal credit cards.

Explain the situation and get the company where you have the license with to also help out. Get them to give you a contact # or email that paypal can use to contact the owner of the company. This will most likely get your money back. Also, paypal only gives your money back if the person has money in his account. Let says he has only $50.00 in his account, thats all you get. Paypal does not go the extra mile to grab the rest from the owners CC, or bank account. Lets just hope if they do decide in your favor that the guy has the 300$ or atleast 60-75% of the amount in there for you.

The fact that it was goods might help you. You could try and say item was never received. The OTHER party then must provide a tracking number or some proof of delivery. Since intangable, he cant.

Actually, we've had a few charge backs (by a former partner of one our clients) reversed; we provide the IP information, our TOS and emails from the individual showing he used the service. It took them a month or two, but the money was returned to us.

If paying via paypal for a website design or custom software, etc., always put in the agreement that they will send the design element, fonts, etc. on CD. CDs are still tangible goods. Also, if possible pay a certain % up front, the remainder on delivery.

In this case, maybe get the actual developers to issue a statement why the license was revoked, e.g. the seller wasn't authorized to sell it to you (because they never paid for it). Either way, it's fraud and paypal should refund your $.

Do you have a proof of despatch & delivery with tracking number or confirmation with signature?

All my orders are 100% tracked and with signature confirmation or if it's ebay & I am selling phone, I also put on invoice the item serial number & phone IMEI number for a reason: buyers on ebay buys 2 phones, one will be faulty and the second new one & swap them to get 100% refund from seller of new phones (sort of scam! I never thought about sort of scam until I sold laptop)

I would file a complaint with Paypal, but give the script license company a telephone call and plead your case. They may give you a complimentary license for at least some period of time given the circumstances, especially as a license does not technically cost them anything [...technically speaking].
