Is there anywere too pickup a free template for a webhost T.O.S? I would just copy an existing one but not sure on the rules regarding this.

Besides for host legal talk to your provider whether that be a reseller or dedicated server provider.

You will need to have your customers comply with the majority of your providers TOS, so that is a good place to start.

Since all of my stuff is in the Host Dime DC (Surpass Hosting, a child company of HD) my TOS was pretty much a copy and paste of Surpass so I could make sure I was within their terms. Then I hired a lawyer to see what else I could add into it to protect myself and my company. You will need to customize it to suit your needs as no 2 hosts are the same. (Got permission to use it). Technically, ToS are protected under copyright laws and belong to the respective company and oyu will need express permission to use it. Now, that being said, a lot of ToS have the same basic concepts in them. Contact your providor and inquire about using theirs as a starting place. Most will not have a problem with that as it helps them ensure (at least theoretically) that you will abide by their ToS.

Copying and pasting are not really good ideas as there must be some points that do not match to your own company's products and services.

The best way is just understand how to write in proper TOS language or consult to a legal consultant :)

The first is cheaper but harder while the second is more expensive but easier :D

That is why you do both. When I first started we talked to the host I had a reseller with about using theirs. They said sure. For things I wanted to add or change (like overdue invoices for example) I consulted a lawyer for. It's much cheaper to have them write a couple paragraphs, as opposed to having them write the whole things for you :D And you always have to abide by the DC your in's ToS, and if you get servers from a different company, their ToS.
