On the 15/04/2009 I was asked by the owner of *******.com and *******.com (Benjamin Tate) to designa new site for *******.com

We agreed on $100, 50% before start and then 50% before files are sent, Which is a very good deal in my opinion.

We started the project well and he sent me $50, I then stayed awake untill midnight to get it completed for him.

Once I thought the design was ready (both pages coded and the design approved by Benjamin) he sent the remaining $50 and I sent him the design.

NOTE: THE DESIGN WAS SENT TO HIM AT THIS POINT

A couple of minutes later he said "I noticed something, but it can wait untill tomorrow" He continued to explain that there was a slight bug in IE which for some reason did not appear on my PC. He said it can wait untill tomorrow, so I left to go to bed.

Day 2
I woke up and was on msn all day yet he never came online. - This made confused as he did say he was going to be up early tomorrow morning, So I paused the design untill I spoke to him to confirm it wasen't dogey.

Day 3
He finally came online at 11:45:20, I started to talk to who I thought was Ben, however I soon realised that it was a support member for his company, so I left a message and was told it would be sent to him.

2 more days passed and I heard nothing from Ben.

Today
I came on today to find a PayPal dispute in my mail box for $100. I waited several hours and finally found his msn online, So I tried to make contact again.

At first I was told the owner was not online, So I again left a message.

A few minutes later hes suddenly online and I start getting several messages saying..

*******.com Support says:
i spoke with the owner..he said that you never finished the template

###END of TIMELINE###

This is not on, I tried my best to finish his work within 3 hours, which is amazing compared to most designers. After staying awake untill midnight we both agreed to call it a day. There is just one IE bug to fix, So I come on the next day and no sign of him (he said he would be on early the next morning) - This seemed a little dogey to me so I decided to wait untill I get in touch with him before continuing.

I think what he has done is appalling, I have tried my best to contact him, What went wrong?

This is simply to warn others before accepting a design job from Ben.

hello,

as far as I was aware the agreement was that you were to send me the finished site as requested.

I never got a working site, I have a half made one with the coding was so bad i couldn't use it.

we spoke on msn messanger and agreed that you would be up the next day to fix the issue and you were going to email it to me.

I have got a full time job, therefore can not be on the internet every minuet of the day. And you did not talk to any of my staff untill 5 minuets ago before you posted this topic.

This case is being reviewed by paypal and they will resolve as they see fit as this is not a public matter.

So I request that you resolve this within paypal, as at the end of the day you can post all you like, that does not change the fact I have not got a working template.

So to finish on a short note, I will be more then happy to drop the case when you can provide me with the full working site.

1) The site works fine appart from the IE bug (which I can fix for you)

2) We agreed to meet on msn the next day you said "I will be up bright and early"

There is not a chance that our staff would have spoken to you. as I said, there is no point in warning people about us, it should be us warning people about you.

Therefore this will be my last post as I don't want to get involved in any games here.

There is no final Template that works.

The bug is in Fire Fox not IE

And there is only myself and a very good friend who is on the support team. I know that this is not him because I am with him now and I was with him when you apparently had this conversation

I refure to take any of the blame for this.

You said a 2 Hour design, you siad yourself it still had bugs and was not working. therefore we will not be willing to pay you for something that does not work properly.

At the end of the day, by you posting this topic your only effecting your own reputation.

I said "I would try and get the design done within 3 hours" - You then said at the end of the 3 hours after me sendign the files "theres a small problem, but it can be sorted tomorrow" - Your just trying to make excuses now.

This is not about my own reputation, I feel I have done nothing wrong and have nothing to hide, It's simply to warn others.

Without being too picky here but rather than posting so called msn conversations, maybe just some advice, deal with this with Paypal, as this meerly certifies minor faults on both sides and does nothing for either's reputations here. In the long run, this will result in diminished business for both sides, therein absolutely pointless to continue. I suggest the victim here use emails sent / not sent to settle the dispute and should a fault be there, it can be made public for paypal to view.

Whoever is at fault here needs to step forward, but it seems no-one wants to take the blame and so this post has just become nothing but a publicised barage between parties, If I was a mod I would lock this and by typing this message have reported this thread.

I must agree Dan, I think it is a good idea for a mod to close this.

I didn't start this to start a fight, It was simply to warn others.

Yes it is a good idea to close this topic. Neither of us want to fight about this.

Should the reverse be a problem, then I would be more then happy to personally come and collect it.

I have had an online Poll across 23 sites.

Looks like should I not have the refund by tonight I will be making an appearence at your house to get it back.

I have been given your full address by a member of your staff. So either please reverse the paypal payments or I will Knock on your door and expect cash in hand.

I have since been contacted by "cesto" and after been threatened that he will come to my house, bring my servers down and multiple other things.

I feel I have no choice but to refund the $100.

I would strongly suggest your file a report with the police if he has made threats
