At the same time, less the price of servers managed

You can provide a service, managed servers and unmanaged servers

and the client can choose managed or unmanaged

You are a wonderful company and I waited for prices less than this and God knows I want to deal with you seriously

I'm waiting for a response from you in the unmanaged servers

First violations of this policy will result in an "Administrative Fee" of $250.00 and your account will be reviewed for possible immediate termination. A second violation will result in an "Administrative Fee" of $500.00 and immediate termination of your account.


Does this mean if someone hacks into our customers account and spams, we will be charged these fees, and on second instance have our account terminated?

You do not have to have us manage your server. It just means if you have an issue or need assistance you can open up a ticket and ask for help. You do not have to give us your root password. We will not login and do anything to your server unless you ask us too.

No if someone hacks into your server this does not apply. This is for actual spammers and its meant to deter them from signing up.

In your TOS, after the bit I quoted previously, this paragraph comes after:

Users who violate this policy agree that in addition to these "Administrative" penalties, they will pay "Research Fees" not to exceed $175.00 per hour that Digital Management Partners, LLC personnel must spend to investigate the matter. PLEASE, DO NOT SPAM from your account.

As our Customers are ultimately responsible for the actions of their clients over the Digital Management Partners, LLC network, it is advisable that Customers develop a similar, or stricter, policy for their clients.

We have never had to enforce that, every now and then we get professional spammers (pose as internet marketing companies). As soon as we see the spamtrap and complaints coming in and looking at there traffic we terminate them.

We have a very reasonable abuse department, as long as you respond and take care of the issue in a timely fashion there will be no issues. And as long as you are pro-active about preventing spammers from using your services there will not be an issue. All you need to do is make sure you do your best to prevent spammers from using your services and make sure you respond to the abuse emails quickly.

You will not find anyone complaining about our services and unreasonable service terminations.

We have to proect the other customers on our network from having there IP addresses being blacklisted because of profesional spam operations or customers who allow spammers to use there services.

All that we ask is you make an effort to prevent it from happending and if it does happend you clean it up ASAP.
