I've got a $300 a month RAQ server with Dialtone and has just completed the minimum 6-month contract. With the prices of RAQ servers going down to $99 a month, I plan to transfer to another provider. The contract I signed with Dialtone stipulate that:

"The duration of this contract is for six (6) months from the commencing date of this Contract. The Contract will be automatically renewed on the anniversary for the same terms unless either party to the Contract shall cancel this Contract with 30 days written notice prior to the anniversary date."

Since I was not able to notify them of the cancellation prior to the anniversary date, the contract was deemed to be automatically renewed for another 6 months (according to the above term).

Question: If I will cancel my account with them now, do you think they will impose the above paragraph and refuse my cancellation? Anyone had any experience with them regarding this matter?

Most services will release you anyway, but that appears to only be in the best interests of the client, you, and to ensure your prices don't go up. I think it should be okay, but ask them and find out. If nothing else, they can possibly pro-rate it, but I don't think that will verify that you committed to having to host with them for another 6 months.

Really? I thought I've heard some fairly positive words about them? Or, is that just their connection and not their fairness or understanding to customer's issues like this?

based on my friend experience
dialtone might charge you some penalty fee
if you cancel your contract after your 6 month contract
and not notify them 30 days before it's over..

Mivo.. just contact your account executive or if you don't know your account executive, contact their sales rep'

I haven't had any experience with them, but your best bet is to give them a ring. Explain your situation, you will probably get a sales/support rep that may just say their terms are posted and that's how it is. This is fairly normal for a lot of places, they are just following their boss's rules. Ask to speak to somebody higher up, their supervisor or department head should do. Generally you should be able to work out a compromise, for it should be in the companies best interest to loose some profit, but keep a customer happy so they are not likely to talk 'trash' about them in the future.

My feeling is that they will cite the contract and may accelerate the charges. I think this is something we have to be careful about regarding contracts. I did not put much weight on this before signing and now I was put in a bind. I'll bide my time a little bit and explore my options before contacting them.

They can be good, they can be bad... for both your host and you. As Chicken said in a earlier post somewhere within these parts, generally if you are in a Contract your price is locked in. Without a contract, you could get a great price for a new host in the area and then they may either become greedy or not generate as much profit as anticipated and hike up the prices. Of course if this happens you can leave, but that can be a mess.

I was in the same situation last year with Dialtone and they were nice enough to let me out of my contract. Just contact them and I'm sure you'll be able to work something out.
