I have 2 reseller account for 4 years by one of hosing companies, after this period i noticed one day that one of reseller accouts is down, and after creating ticket i found out server has problem and they should reinstall OS and after that they said hard drive faild and they have no data, i want to know is there any way to complain this company? any one knowes any law regarding to loosing customers data?

Do they provide a backup or is it your responsibility to backup your data? Check their TOS.

First of all i prefer not to say their name now, in their TOS nothing regarding to backup but in reseller page dayly backup is mentioned,

I have one more reseller accounts with them, and i dont to loose more data because mentioning their name, i will say as soon as i migrate from them totaly,
Just please help me regarding to this situation, i should answer my customers for what the said they do and they havent,

First of all i prefer not to say their name now, in their TOS nothing regarding to backup but in reseller page dayly backup is mentioned,
Then they should have a backup unless their backup drive died also :-(

i want to know what can i do now Our personal opinions presented here may vary. If you feel very strongly about this and are serious about going to court, the only real way forward is to contact a lawyer. Best of luck!

And in reseller hosting page mentioned they have daily backups
are they responsible or no?

If both drives died, then there is nothing you can do :-( especially when they mentioned that it their TOS also.

It says right there in plain english that they are in "NO way responsible".
Sorry to hear about your troubles and it sucks that it takes an event like this for people to think about stuff like backups.
edit:
Even if they were responsible the data seems to be gone so it might be best to start moving on.

You should always back up your customers files to ensure security for your customers should hardware fail.
You will have to explain to your customers about the hardware failure and their data is lost.

How can a reseller get backups of users data?

He should have the option to do backups in his control panel. You can set it up to backup to a remote location.

Here's what you do.
1. If the data is important to you setup 3rd party automated backups which you test during initial deployment to validate good backups and then test on a regular basis.
Even if the company provided you with your own data backup you should ALWAYS make your own backups, period.
2. Learn from this, move on and backup your data!

Their contol panel is plesk how can i get backup, where can i set backup to remote location for all reseller accounts?

i learned but can you explain which 3rd party software can take backup of reseller accouts? please tell me some names of softwares,

Most hosting providers state in their tos that they are not responsible for your data and that you should back up your site regularly. So unless your host has your back up or has that stated in their tos there is nothing you can really do about that.
