View Full Version : EarHost is alive!!!!
cwshost 09-08-2002, 06:31 PM Today I was talking to Tim via the phone (866-EARHOST) and he told me that they are still working, they had some bad servers that the main site was on and it does not work, he told be that he purchased several new servers for the Global Compass Data Center and would be running in 2 weeks.
I stated that he leased a server from Rack Easy and that it was on his part a bad move due to the problems that they are causing.

I stayed even after the first cpanel problem.Then once that was fixed the DNS problems started.After about 3 weeks of my sites only being available at random times of the day he moved me to a new server.DNS problems continued and now its down totally.Im betting either he got his last server shut down or saw my request here for a new host and deleted my sites.
I was calling to get a refund ,but im guessing I have a better chance at becoming the next Miss America.(Yes i am a Man)
Almost forgot Cpanel was down for the 2nd time(longer than just a day or two) before he moved me to the new server

No, he is a month behind on one of his server's, and in four days he will owe us $200.00 for one server, and $200.00 for the other, not even including for the server $$ he is behind. The server which he is a month behind on which is the one you cwshost is on is the one he hasn't paid for in an month. Yet Timmah has the nerve's to tell you we we're causing problems?
I've talked to Tim this evening right before you called me, I was going to unplug the servers a few days ago, but he begged for me to keep them on.

You might try emailing the domains on the serve before you kill it..
Just shut it off to WHM, FTP, SMTP, CPANEL, and SSH traffic..
Basicly just leave web traffic open on it, so timmah can't do anything to the box, but the customers can still get your email
Maybe even leave FTP open so they can get their files...

The server(s) have already been took under-control, we've emailed all user's we're just waiting on an reply.

It sucks, but to make sure people get the idea that the server is gonna go buhbye, you might have to shut off apache for a few hours...

my suggestion to all you customers of earhost: call the tollfree number and ask for a refund. If the refund isn't posted within 7 business days, ask your credit card company for a chargeback.
and for all those who are owed money from timmy and co.....send a demand for payment , demanding payment within 15 days. if he does not pay up, call the attorney general's office in his state and file a fraudulent sales complaint, and also a wire fraud complaint on the peoples behalf - then call your lawyer, and have him file a suit in civil court

ChickenSteak, Do you really think it is a smart idea to be talking about people personal finances in a public forum? Don't you have a privacy policy? If these were my servers (first off the damn bill would be paid but..) and the payment was late and you came to a public forum and announced that the servers were late.. we would have a serious problem. What you have done here is 100% unprofessional and frankly i hope others see this fact. Maybe you should stop and think before you actually post details like this about someone's account.
Talking in general about a customers account or how late they are is one thing... such as "I have one customer thats over 2 months late on payment", however saying something like "Mr.X is 2 months late and owes me $200" is uncalled for.

Yes your right, and I agree with that. Although, when he stoped making payments, he voided the whole contract, please don't get me wrong now, but yes you are right although again he voided the contract, so we don't have anything we are intitle to do or not do.

Sorry, I just feel you as a company have a obligation to keep these matters private and deal with them in a professional manner, no matter the status of the contract.
I have a few customers that have not paid me in the past... This does not give me the right to go posting thier credit card numbers on this board.

1. A minor's signture is no good on a contract.
2. You can only sue his parents under special circumstances which vary by State.
3. On the criminal charges, as we have seen of late, they may go after him, if the case is worth it.
Heres a twist example for you: Adults use minor child as the front person as a way to side step civil lawsuits.
As a minor child, he might say as a minor, you adults took advantage of him!
I would not tell my CC company I want to do a chargeback on an underage child. For in fact, you have no valid contract due to his age.
No I am not sticking up for him, but giving you people a heads up.
I know there is some per-law and or law students here, step in at anytime.

But here is a small twist. His dad has something to do with it. In another post, someone said they visited tim, and apperently his dad is his partner. What I just dont understand, why dosent someone CALL his parents, tell them wtf is going on, you honestly think a parent would allow this type of risky buissness to go on? I mean if I had done anything like that, I would be cut off from my family, heh

I decided a long time ago... that i have never, am not, and will never due business with Tim... just due to his reputation. This policy of mine seems to be working fine for me so far and i am sure it will in the future.
Then again... I am not the one out over $400 right now. ;)

Tim never signed any contracts as far as I know, it was his uncle's job to do that.

In another thread, someone did call up and got the old man, however he didn't seem to give a damn what his son was up to. Even though he was told his son was commiting fraud, etc, etc.

Has any action been taken against these scam artists?
Atlonim 09-08-2002, 11:28 PM Personally I'm sick of "Timmahh" threads, but I do understand, that public should be informed and warned.
However I do NOT understand "Victims", which do not undertake any steps to resolve fraudulent activities of TIM, JAMES and all others for this matter.
Forget the lawyers, collection agencies, local law enforcement, BBB... Chances that something will be done are slim.
What you CAN do, is to file a complaint at: http://www1.ifccfbi.gov/cf1.asp
It takes only ten (10) complaints and FBI will start to investigate and/or pass the case to state authorities.
So I suggest that all "Victims go there and matter will be resolved in a month or so.
How do I know that?
Well, I myself had to file complaint in unrelated case (Sharperdigital.com), and I've got my refunds and responsible people are doing the time...
So, go to http://www1.ifccfbi.gov/cf1.asp and do your duty...

I have filed reports with both local BBB where Tim and James are located. Next step is filing a polce report, which is a bit more involved and confusing, as the transaction took place over the internet. I have also looked into contacting the local newstations, both have "Problem Solver / Whistle Blowers" segments, so we'll see how that goes.

I believe there was another thread regarding tim selling multiple copies of the same design. Not sure what thread, but im damned sure I saw it.

Thanks the MMiz, I haven't done any research on it as I have no monetary gains, nor losses and at my age it could be construed as stalking I'm assuming, but if I see his little twerp ass anywhere near my customers, partners, or anyone else I care about I will expose him in anyway I can.

Derek 09-09-2002, 11:56 AM Ok, R K Raja makes the designs (all of the good ones) and Tim sells them for a big commission (35-40% I believe). Raja made the design for RackEasy but will be making a new one, therefore RackEasy has not finished their current site.
Now, about Tim, I have not had any problems with him but his reputation is making him look dumb. I wish that he would either come clean with everyone or get off the net.

Reptilian Feline 09-10-2002, 03:03 AM I enjoy these kinds of threads. They help me a lot towards my future goal as a webhost (small version). I do hope everything gets resolved. People not paying their bills should be put on some list that webhosts and resellers could read, like some kind of credit-checking-service. We have that in Sweden. Doesn't that exist in other countries?
