In my TOS I have this
*** Host's servers' shall not be used for the sole purpose as a file server, FTP Server, streaming video, streaming audio, or other such means that will deem inappropriate and that may hinder the performance of *** Host's servers'. IE: Purchasing a reseller account and using it in the nature as described in the previous sentence of this paragraph.

Depends really.
Personally I'd never use a host that has that in the contract because it makes me think that the host is overselling heavily, and they could easily use it to cut a contract short if you decide to actually use what you're paying for.

Well, the concern here is that you get some that want to open the next gamespy or gamespot and instead if using the reseller account of what it is for they abuse it

You could add clauses relating to abuse of resources such as CPU/RAM for that, but if you're not heavily overselling then I don't see the need to restrict your users on space and bandwidth they've paid for.
I'm sure some will disagree with me on this, but those are my personal feelings on the issue. I'm just really not a fan of the whole "we'll sell you the world for a dollar, but you're not allowed to use it" tactic. ;)

So, what's the problem if they use part of it as?
Like Btcc22 suggested, just mention something about "abuse of resources" or something. But then, judging by your third post (post #6), it looks like you're more concerned about them using the disk space you alloted them.
I'd like to defer back to Btcc22 again then and say, "don't offer that much then".

If you're not overselling it will not pose a problem, however you still need to have CPU/Memory restrictions in place. I would also suggesting having a clause that using your account as a storage space is not allowed, and 80% of your files should be linked to from a web page. That would be more than enough.
