After finally leaving RackShack I finished up my true story on how they managed to take over $300 from me. To keep things sane I have posted the entire story to a website which I can update as needed here:

Thats why if i ever did get a dedicated server, i would build it and load the OS myself including any other software like cpanel and test it and make sure its secure ect ect. and colo it

You're lucky they offered you a $100 refund...

Refund and Disputes: All payments to RackShack, Inc. are nonrefundable. This includes the one time setup fee and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 60 days of the time the dispute occurred. If you dispute a charge to your credit card issuer that, in RackShack's sole discretion is a valid charge under the provisions of the TOS and /or AUP, you agree to pay RackShack an "Administrative Fee" of not less than $50 and not more than $150.


See, right from the rackshack TOS.


BTW since when have the rackshack pages been in ASP? Could they be testing out their windows servers or whatever?

I don't care if it is in their TOS or not. They clearly did not deliver the service that I paid for. You can not contractually write that off. They broke their end of the agreement yet they refuse to refund my money.

It is in the hands of the BBB and NYS Consumer Protection Agency now. If they can't sway RackShack I'll do a chargeback.

Don't feel too bad, I lost out on considerably more than $300 with Rackshack and I even ended up losing another few hundred because their ticket system was off-line when I wanted to cancel -- another few days went by (and a weekend) before it was back up. I needed responses to a hardware issue to see if I had any options (if they'd actually log in at the console and type one command that's 20 characters long, rather than their "we'll reinstall it only" nonsense they don't clearly state in their TOS upon sign up), before I would put in the cancellation notice, and due to their downtime of the member help desk, and lack of help on the phone, I lost that much more.

Trust me, even if you lost out a few grand, you're better off losing that much and just hosting at a real data center that's more respectable and has some worth, than you are paying someone to just use bandwidth and getting no other service. Don't sweat it, move on. I can understand the principal, but this will get you nowhere and the BBB can't force them to do anything. Maybe you'll get lucky (I wasn't, that's for sure) and they'll be willing to refund the money you paid for non service. I know I sure paid a lot for my non service (which I apparently agreed to, even though it said nowhere in their terms that they will only reboot or reinstall (note for the cynical RS defenders, this was _not_ me needing hand holding or something _I_ did)). Anyway, good luck, really.

You are really unlucky to get a faulty server from them and got such bad business attitude from rs staff.

Some credit card issuing banks allow chargebacks up to 6 months after. Have you checked into that? The burden of getting paid should definitely be on rackshack for this one.

i think rs uses totally different servers from like another company from their site which in my opinion is smart cause say the whole datacenter goes down they can still provide support.....

There were a lot of reboot requests:eek: ...it makes RS sound very unreliable. A good host should only need to reboot maybe once or twice a year. Hopefully you get your money back and didn't lose too much money if you are running a business.

While that is true, these are dedicated servers, unmanaged that allow clients to do whatever they want or can (on purpose or not). So they don't control how stable the system is or see frequent reboots are an indication to a problem.
