And a more important question: why do you believe it's even legal to have someone doing this for free? Because it very likely isn't. AOL was hit with a class-action lawsuit over this issue (it hasn't yet been settled, but you can read about it at http://news.cnet.com/news/0-1005-200-342941.html - they will probably lose or settle.)

The U.S. Fair Labor Standards Act requires that a minimum wage (Federally, $5.15 per hour, but some states set it higher - Massachusetts, for example, has a $6.75 per hour minimum wage). And, if you are found to be violating the Fair Labor Standards Act, the Department of Labor may recover back wages for all affected employes, as well as fines of up to $1,000 per violation (if the employee is over 18 - up to $10,000 per violation if the employee is under 18).

Now, obviously, you have to figure out whether what you are asking these people to do would qualify them as employees. I don't know - I honestly don't know the law as to what qualifies employees and what doesn't. But, unless you run this past your attorney to make absolutely sure you're not violating this law, I would be *extremely* cautious about using volunteers of any type.

Just my advice - I'm not a lawyer, but I am a business owner, so I am moderately familiar with labor laws, and I can tell you that you do *not* want to mess around with them.

I think he just wants people for the "fun" of it, like a hobby for now in a hope that it will turn into something...

Cheatman.net is not hiring employees but looking for staff members to help out with creating the site, treating them as partners with the profit but not the expense, they would not be working for free, but for a % of profits earned.

Because i can classify them as partners, there is not a way anyone can get any lawsuits brought against them.
