Their support is really bad... and so their service. From my experience stay away from them.

I would keep trying to contact their support department to see if they could provide you with account backups (or if you can log into your control panel you can attempt to make them there).

If the host is going under (and if they are renting their servers) they will have the servers repossessed and you most likely won't get a chance to get your data if you pursue legal means (because it will take quite some time to file the lawsuit, hear the case, get resolution, etc.)

thats what i do, i submit a ticket and send emails and the strange think they still sell services through EBAY, poor buyers! I have backups but is old. So i need the latest. i have access to the cpanel but i cannot perform backups. I just want to move away. Their service really is very bad. I also tried to contact them over the phone without any result.

Has the backup feature always been disabled in cPanel? That's odd that they would not allow you to make your own backups...

no it is enable. the server load is too high thats why i cant backup. The problem is that they don't fix the server and dont respond to the tickets!

Are you able to get into cPanel at all? If so maybe try phpMyAdmin to get a export of the databases you need. Though with load high, I'm thinking you probably can't. In the case, if they won't help you then you might be out of luck. :(

Tell them in all possible ways (call them, support ticket, email to info/admin/webmaster/sales/support@theirsite.tld) that you will get a lawyer and sue them if you do not get your files back within 48 hours.

If they don't reply, then get a lawyer.
