I would just like to let everyone know about my experience that I have had at vibrantstreamnetworks.com
This person named Kody, claims that he has a Large business but it is really a small and corrupted business, that i believe is operated by 1 person (kody himself)
Anyways, I purchased ShoutCast hosting from him for one of my clients, and I received my second month's invoice, and it isnt even the second month yet. I asked him to cancel my service because my client did not want it anymore. This is the reply i got from him
"I will after the payment is made"
I followed up by saying the following
"I am not making a payment for this month, i already paid the first month...
i dont want a second month service..."
VibrantStream Replied...
"Thats not how it works.Once the invoice is issued, it must be paid. Your allowed to cancel 10 days within the billing date of the invocie. "
It says nothing about this in his TOS/AUP
It just states the following...
Late Payments:
If payment on your account is not received by the due date, VibrantStream Networks will suspend your account within 48 hours of the due date. In the event of an outstanding balance for 7 days, a late payment fee of $5.00 will be applied to your account. In the event that the full balance plus late fees is not settled within 10 days of the due date, your account will be terminated. Account reactivation after suspension may take up to 24 hours and VibrantStream Networks reserve the right to delay or refuse reactivation at their sole discretion. Late payment suspensions are treated on a customer level and not on a domain/package level. Account data backups will only be provided after payment has been settled in full, including any late fees payable. Once an account is terminated VibrantStream Networks will not be able to recover any data from your account.
Vibrant stream networks then told me that they were going to turn me into collections.
I just felt that everyone thinking about purchasing from VibrantStream Networks should read this and look into other options!

First of all I would like to defend our business. It is ran by more than one person, and I wouldn't call us a "Large Business." We most certainly are a Small Business.

Your invoice date is 01/31/2008 [January 31st 2008]. This would technically mean that your already running on your new month once this invoice has been issued. We allow you to cancel your services with us at anytime with no charges occuring to your account; BUT; If the invoice is generated and then you wish to cancel, you must pay the remaining fees on the account and then submit a cancellation thru the billing department.
I would also like to tell WHT that his story above is pretty much a bribe to make me cancel the invoice that is due.
"Now, you can delete my hosting account, and the invoice, or I will continue posting about what you are trying to do..."

Also what Kody is doing is what the vast majority of hosts on here do. They are not scamming you, infact it is more like you scamming them. Your invoice has been issued, and was due yesterday, so you should pay your balance and then request to have your account closed.
The latest future date that can be submitted for cancellation is the day that your current payment period expires.According to this that last day you could ask for account termination was on Wednesday.

As stated above, the invoice has been created and we DO NOT allow you to cancel the invoice once it has been created. Once the invoice is issued, it must be paid.

Once again your absolutely correct. Scam is really a strong word and this is definitely not a scam as which you can tell by reading above.

Could you extend a courtesy and terminate my account? As shown in my control panel, I still have my ShoutCast for another few hours today, and, on top of that, I have not received an invoice in my account. According to your Terms of Service, cancellations will take 24 - 48 hours, and can be cancelled before the next invoice is due. According your standards, the creation of the invoice takes place at the beginning of subscribed month, so it seems as if you are:
a) Being dishonest -- forcing customers into another month of hosting that they do not want
b) Not clearly defining 'invoice'.
If the answer is a, I will be contacting the Better Business Bureau about the issue, and if the answer is B, I look forward to your response and hopefully a charge-free termination.

According to my Billing account, I'm charged for the next period while the current period is active. I now realize that you are not charged at the beginning of the period -- a misunderstanding. (Sorry for that).
Regardless, I do not have 5 days to pay this. This was a huge oversight on the companies part, and I will be unable to pay the bill due to this. Because the company itself violated the Terms of Service, I'm hereby refusing to pay. I'd be glad to continue arguing over this if you feel that this is unfair of me.

Hello Ryan,
As you state, "I will contact the BBB..." I will tell them the same thing I told you. You have to face the facts. When you signed up you agreed to the Terms of Service. Your account gets suspended in 2 days, so i'm giving you 3 days free.... I think thats well enough extension of the courtesy.
In regards to not receiving the invoice, I checked our server status for Mail and its currently off line as their upgrading the unit. You will receive it within the hour.

OK lets put it another way. I am a client of yours and I have your personal shared hosting plan from your site, cost $5.95.
When I sign up I neglect to read the TOS and am issued an invoice for my second month, because I did not cancel in the time specified in your TOS. 2 days into my second month of service, a month I do not want to use, I contact you and say "Cancel my account please, oh and by the way I am not paying the invoice you have generated for me. Also if you do not then I will be posting bad things on WHT about you".
What would YOU do? I will tell you what I would do once you have replied. ;)

I have not received the EMail. Perhaps the DNS and internet/intranet conflicts within the network are stating that it was sent, but it is not. If your server has any queued up mail, you'll want to send that off. However, I still have not received an email, and I am not paying for this. I have cancelled before the email was sent.
P.S. Your logs confuse me. Also, this was quoted. You have obviously edited the logs to make them more favorable in your defense.

The email was delivered to your box successfully. The logs show time, and date that the emails were sent. (Time = Military Time) along with the subject of each message.

This is how I feel, and my personal review, thought, and opinion on the company. As the thread owner, I request that it be left open. People are here for the truth against companies who abuse their customers.
futhermore, I believe that you'd like this closed to prevent the downfall of your company, just the same as what happened with your former company, Attaxhosting.

We have many happy customers who have stuck with us since the beginning. By all the evidence I have givin, you can tell that your in the wrong. You requested cancellation after the invoice was issued and thats against our policy. All fees on the account must be paid before you may cancel.

Clearly, the account was not due for renewal until today. He does not want to continue the service. Maybe he should have sent advance notice, but it doesn't cost you a red cent to cancel him now and being a real jerk over a few dollars doesn't help anyone.
And just a "FYI", no collections agency is going to take a case over $10 or however much this is (the max cost, as far as I can see, is $11 per month).

You might have taken it the wrong way, but I didnt know how else to word it. We take multiple steps to get the user to pay before we actually do that. By the time we get to that point, the fees add up.

Unlimited Bandwidth, yes if you pay your monthly renewal which you have failed to do. Since your month started over and the radio has been used therefore bandwidth fees have occurred.

Your month restarted at 9PM (EST) when all invoices were sent out. 9PM is the time for official billing to be closed for the day. 9PM is also when accounts are reset if they need be.

Cast-Control Logs show that 186.13MB of bandwidth has been used.
And we sent out an email 2 weeks prior letting everyone know we were moving our Cast-Control server.

Your month restarted at 9PM (EST) when all invoices were sent out. 9PM is the time for official billing to be closed for the day. 9PM is also when accounts are reset if they need be.

First off. It does not matter whether he says he is a big business if he isn't. If he is or not, was that little bit of info affecting the service at all? No. A direct attack... Irrelevant.
Second off. VSN is a network of a lot of people. I know this cause I am among them. As the website designer and manager for the VSN site.
Third off. You CANNOT have your hosting canceled by your terms. In order to cancel a hosting package... it has to be all paid off. Like a 3 year contract with a cell phone service provider. You cannot leave until you're all paid off.
Fourth off. Posting whiny crap like this is not only disrespectful to VSN, but it is immature. If you have an issue with VSN's policies, then contact Kody. I am sure he is more than willing to listen and maybe remind you of certain things that cannot be avoided or changed.
Note that I not only speak as a part of VSN, but also a customer. I have been with VSN since I started buying hosting and have had no issues thus far.

During this time we talked, you talked about canceling but never actually submitted the Request of Cancellation until 10:32 PM EST.

Cancellations:
All cancellation requests must be submitted from within our Member's Center. In the event of a cancellation request being received by VibrantStream Networks, unless requested otherwise cancellation will take place immediately. Cancellation results in all data under the affected account(s) being removed at the end of the billing term this is non-reversible, due to this you should ensure you have a backup of your files before requesting cancellation.

He is not a scam artist, nor is he trying to rip anyone off. Him and all his employees, colleagues, friends, etc are just trying to provide good hosting. But know that there a terms and service agreements you agreed to upon registering an account with VSN.
You are subject to those terms like anyone else is. Like I am. I've been in the same place as you. I knew and accepted that I had to completely pay off owed invoices in order to cancel that account. You should too.

If you are not listening, being rude, or refusing to understand the TOS Kody explains to you in an MSN meeting, then you are subject to being blocked. If you are hard to deal with... Kody will not deal with you.
My advice for you right now. Pay that invoice. You are the one at wrong here for not doing so. Now quit arguing and pay the due payments.

I checked with the Kentucky Secretary of State, and there is no company doing business as "Vibrant Stream Networks" or any variation. I highly doubt you have a PERSONAL contract with the buyer, so you have no legal ground here.
